Canadian Regulation Principles

Harmonize with others:

  • Incorporation by reference UNECE-58 Agreement Regs (e.g. UNECE Regs for headlamps, UNECE 97-Theft, mirrors under review)

Hampered by:

  • Significant safety differences (e.g. pass. car side marker lamps, fuel system integrity 80 km/h, vehicle classification)
  • Climate(e.g. corrosion/humidity/dust tests for lamps, defroster test)
  • Self certification vs type approval (language e.g. appreciable transparent, about 5 mm thick, )

  • Obligation to initiate gtr adoption (if not abstaining)
  • No obligation to adopt part or all
    • must advise Secretary-General of any decision to not adopt the gtr and the basis for that decision
  • National regulations could incorporate:
    • only parts of gtr requirements - modules
    • include additional requirements beyond gtr…. But will jeopardize global harmonization

6 Phases in gtr development process

  • Phase 1. – Compendium - AC.3 vote
  • Phase 2. – gtr proposal - AC.3 vote
  • Phase 3. – preliminary report - AC.3 review
  • Phase 4. – gtr development - CDN contribution
  • Phase 5. – gtr establishment - CDN consultation
  • Phase 6. – gtr adoption - AC.3 vote
  • Formal CDN regulatory development process starts

Ultimate goal is to adopt all gtr requirements

  • Case 1: Existing similar Canadian regulation
    • Canada will consider proposing gtr provisions as alternative performance requirements
    • Compliance with ‘existing’ regulation may continue
  • Case 2: No existing Canadian regulation
    • Canada would propose gtr as new regulation
    • industry will be given reasonable ‘lead time’

  • Several items still under discussion (presence of side marker lamps, rear fog lamps, DRL, etc.; aiming of headlamps; devices installation height; etc.)
    • Potential solutions:
      • Find common area for compliance
      • Eliminate some disputed provisions and leave limited number of items as options for future resolution
      • Include all issues as options
      • Continue talking …
