  2. IEBC Background Encourage the use and re-use of existing buildings while requiring reasonable upgrades and improvements in code compliance.

WI IEBC History • Replaces S&B Existing Building Guidelines, Wisconsin Historic Code (Comm ch. 70) and IBC ch. 34, which share similarities with IEBC. • Provides a more predictable alternative than one or more petitions for variance • Note that there is no distinction between buildings originally approved under ICC suite or pre-ICC Wisconsin codes • Note that per s. 101.121, WI Stats, local ordinances may not be anymore restrictive for historic building projects approved per this code

  4. IEBC Approach New work intended by the owner is generally regulated by the IBC, IMC, etc., but additional upgrades maybe triggered by the IEBC depending on the type and extent of the intended work.

  6. s. Comm 66.0101(1) Application Does not apply to unchanged existing buildings which are instead subject to: • Per s. Comm 61.03(13) for post-1914 structures: • Buildings shall continue to comply with applicable State Building Code • Bleachers and grandstands shall comply with ICC 300-02 Bleacher Standard – annual owner inspections and retroactive 4” guard infills • Or chs. Comm 75-79 Buildings Constructed Prior to 1914 (previously titled, Existing Buildings Code) • And applicable fire prevention codes, ch. Comm 14 & IFC or NFPA-1

  7. 2007 ICC 300 Bleacher & Grandstand Standard Adopted per IBC 1028 • Retroactive 4” bleacher guard infill at perimeter and between seats and footboards

Comm 66.0101(2) Change of Use to a Public Building • Change of Occupancy to a Public Building Occupancy from non-commercial use – comply with new construction requirements per IBC, rather than IEBC, except that archaic materials may continue to be used • Revised Comm 66.0101(2)(b)2. to allow qualified historic buildings including 1&2 family dwellings to use the IEBC • May petition to use IEBC or alternative compliance for other non-commercial buildings • Also requires that initial tenant spaces plans following shell approval shall meet new construction requirements of IBC

Comm 61.30 Plan Submittal • Required for new buildings, additions and alterations • Change of Use - There is NO requirement that a plan has to be submitted to gain an approval for a change in use. Submittal requirements exist only for the plans of the alteration work that is often desired or required with a change a use. • 61.30(4) Minor Alterations - If the code official can understand the proposed project and agree that compliance can be achieved without having plans to work from, no submittal of plans is necessary - Document the decision!

Comm 66.0101(4) Compliance Methods Elect to use for alterations and changes of use: • IEBC chs. 4-12, as appropriate • Or IEBC ch. 13 for those topics covered, use IEBC for rest • Or could also use current IBC, IMC, IFGC, etal. – in any case, don’t have to do more than what the prevailing codes would require

IEBC ch. 2 Definitions • Alteration – Further defined in IEBC ch. 4 • Dangerous, Substantial Damage, Substantial Structural Damage and Unsafe Buildings – ch. 66 Deleted 506.2 and 506.2.5, although code official may still require analysis • Historic Building – WI amendment to be a qualified historic building per s. Comm 61.04(5) • Primary Function – alterations to this triggers additional accessibility improvements • Repair – maintenance, limited in scope, not overall alterations • Technically Infeasible – for accessibility purposes, same as before • Work Area – reconfigured space for purposes of level 2 or 3 alterations

IEBC Ch. 5 Repairs • Repair or maintenance work is to a building, which encloses some space, not the rebuilding of total burnouts or collapses • Code at original time of installation applies unless IEBC ch 5 requires upgrade • No plan submittal to state unless locally required to document work

  18. Revised 66.0500 – Carbon Monoxide Alarms for Smaller Existing CBRFs • Retroactive requirement for existing CBRFs serving 9-20 residents to install carbon monoxide alarms similar to Comm 62.1200 requirements • Deadline of January 1, 2013

  19. RepairsIEBC 501.2 & 501.3 Permitted Materials Options • Materials applicable for new construction per IBC, IMC, etc • Like materials permitted provided no increased hazard to life, health or property is created.

  20. RepairsIEBC 502.1 Hazardous Materials • Hazardous materials no longer permitted to be used in a repair • Asbestos, • Lead based paint, • Etc.

RepairsIEBC 502.2 Glazing in Hazardous Locations • Replacement of broken glazing in hazardous locations to comply with the applicable requirements of IBC ch 24 • Exceptions: glass block walls, louvered windows, and jalousies repaired with like materials. • (Note that most wired glass is not allowed for replacement in doors and sidelights)

IEBC Chapter 6 - Level 1 Alteration • General removal and replacement of various materials regardless of need for maintenance or repair • No area limitations in order to be considered a Level 1 Alteration • Current IBC, IMC, etc. or IEBC ch. 6 applies, including to any new work. • May or may not require plan submittal depending on work and code official’s determination

  23. Revised Comm 66.0503 – Smoke Alarm Maintenance • Require replacement of smoke alarms per their listing • Replacement battery-powered smoke alarms shall have a 10-year, non-replaceable, non-removable battery

  24. Level 1 AlterationsIEBC 605Accessibility • Alterations must meet new construction requirements, with exceptions. • If the alterations include a primary function area, an accessible route, including sanitary facilities, to the area may be required as well.

Comm 66.0100 Note re WI Fair Housing Law • The requirements of s. 101.132, Stats., may be more restrictive than the IEBC when a project involves the remodeling of housing with three or more units • 4 Basic Requirements: • An accessible entrance • Accessible public/common use areas • Accessible doors & int. passage • Accessible features like accessible controls, grab bar reinforcement & lever handles

Fair Housing LawRemodeling Scenarios • > 50% of the interior square footage of the housing is remodeled, the entire housing shall conform to the standards • If 25% to 50% is remodeled, that part of the housing that is remodeled shall conform to the standards • If < 25% is remodeled, the remodeling is not subject to the standards unless the alteration involves work on doors, entrances, exits or toilet rooms, in which case those elements shall conform to the standards • Disproportionality may limit expense to 20% of the project

Level 1 AlterationsIEBC 605.1 Accessibility • Other IEBC 605.1 Exceptions • An accessible route not required unless altering a primary function area • Accessible means of egress not required • Type B dwelling units not required by IEBC but may be required per WI Fair Housing Law – see Comm 61.0100 • If a privately owned residential unit was originally designed as an “’A’ Type Unit”, the private owner of the unit may modify the unit to be a Type B Unit.

  29. Level 1 AlterationsIEBC 605.1 Accessibility • Sections 605.1.1 through 605.1.12 relax the new construction accessibility requirements that would otherwise apply to existing elements that are being altered.

  30. Section 605.1.1 Entrances ...when altering an entrance and the building already has an accessible entrance on an accessible route, the altered entrance need not be made accessible unless called for by s. 605.2 (Alterations Affecting an Area Containing a Primary Function)

  31. Section 605.1.2 Elevators ...altered elements shall comply with ASME A17.1 and ICC/ANSI A117.1 for all elevators in a bank...

  32. Section 605.1.3 Platform Lifts ...complying with ICC A117.1 and installed in accordance with ASME A18.1 shall be permitted as component of accessible route.

  33. Section 605.1.4 Ramps ...steeper than allowed in IBC 1010, reference table 605.1.4... 1:10 – 1:8 max rise 3 inches 1:12 – 1:10 max rise 6 inches

  34. Section 605.1.5 Dining Areas ...unlike new const., access is NOT required to raised or sunken dining areas or outdoor seating areas provided the same service and decor exists in an accessible space.

  35. Section 605.1.6 Performance Areas ...where technically infeasible to alter performance areas...at least one of each type shall be made accessible.

  36. Section 605.1.7 Jury boxes ...access not required within defined area of jury or witness stand where ramp or lift poses a hazard or restricts egress.

  37. Section 605.1.8 &.9 Dwelling & Sleeping Units When altering residential units, the accessibility requirements only apply only to the quantity of the spaces being altered at that time.

  38. Section 605.1.10 Toilet Rooms ...technical infeasibility will permit the unisex toilet room on the same floor in the same area...

  39. Section 605.1.11 Fitting Room ...technical infeasibility will permit one accessible room on same floor in same area permitted... When fitting rooms provided for separate sex, each to have access as well.

  40. Section 605.1.13 Thresholds ...3/4” maximum height with beveled edges.

  41. Section 605.2 Alterations Affecting Areas of Primary Function ...access to or areas containing a primary function...that route shall be accessible. Exceptions... • Disproportionate cost – up to 20% of project cost but no more than needed to achieve full accessibility • Alterations solely to windows, hardware, controls, etc. • Alterations solely to systems like mechanical, electrical, fire protection, etc. or to mitigate hazards • Alterations to increase accessibility

  42. Accessibility • Primary Function Area Examples • Customer services lobby of a bank • Dining area of a cafeteria • Meeting rooms in a conference center • Offices and other work areas in which the activities of the facility are carried out

  43. Accessibility • Not Primary Function Areas • Non-occupiable spaces which are frequented only by repair personnel • Mechanical rooms • Boiler rooms • Other areas • Supply storage rooms • Employee lounges or locker rooms • Janitorial closets • Restrooms

  44. Accessible Route to Primary Function Area shall connect/include the following: • Exterior accessible route • Parking • Loading zones • Entrance • Interior accessible route • Toilet rooms • Drinking fountains • Signage

  45. Level 1 AlterationsSection 606 Structural • Generally per IEBC, current structural requirements generally apply to new work or new loads imposed except for <5% load increases

  46. Level 1 AlterationsEnergy Conservation • Comm 66.0607/66.0711/66.0808 • Except as specified in sub. (2), additions, alterations, renovations or repairs to an existing building, building system or portion thereof shall conform to the current provisions of the IECC

  47. Chapter 6Energy Conservation • Comm 66.0607Exceptions. All of the following need not comply provided the energy use of the building is not increased. • Storm windows installed over existing fenestration • Glass only replacements in an existing sash and frame • Existing ceiling, wall or floor cavities exposed during construction provided that these cavities are filled with insulation • Construction where the existing roof, wall or floor cavity is not exposed

  48. Chapter 7Level 2 Alterations • Description: • Reconfiguration of space • Addition or elimination of a door or window • Reconfiguration or extension of a system, or • Installation of additional equipment • Comply with IEBC chs. 6 & 7 • New work per IBC, etc., except Note 701.3 Ex. 3 that allows new 50’ deadends • Note 701.3 Ex. 4 that allows 7’ headroom in new spaces

  49. Level 2 AlterationsChapter 7 Work Area Level 2 alteration has < 50% of the building area in (reconfigured) work area (Building area is floor area on all stories measured between exterior walls or firewalls) • Exception for accessibility-only alterations • Work area does not include the addition or elimination of window, reconfiguration or extension of a system, or the installation of additional equipment • Not cumulative over time
