  3. 1- Policy • On March 29, 2011, Law on “Prevention, Suppression against Human Trafficking” was approved by the National Assembly • Come into valid from January 1, 2012 • On July 14, 2004, Vietnamese Government approved the National Program on Human Trafficking Prevention (herein after referred to as 130/CP Program) for period 2004-2010, focusing on 4 Projects: • Project 1:Conduct propagandization and awareness raising on anti-TIP in community • Project 2:Investigate and suppress traffickers • Project 3:Receive and support victims for their re-integration into community • Project 4:Develop and complete legal documentary system on anti-TIP

  4. 1- Policy • On August 18, 2011, Vietnamese Government approved the National Action Program on Human Trafficking Prevention and Suppression for period 2011-2015, focusing on 5 projects: • Project1:“Strengthen propagandization & education on law and policy in order to raise the awareness and enhance community’s skills of prevention and suppression against human trafficking” – in charge by Ministry of Information and Communication • Project2: “Increase efficiency in suppression against human trafficking” – in charge by Ministry of Public Security • Project 3:“Receive, identify, protect and support returnees of trafficking” – in charge by Ministry of Labor – Invalids and Social Affairs • Project4:“Establish, complete law and policy documents system on anti-human trafficking as well as law & policy monitoring” – in charge by Ministry of Public Security • Project5:“Enhance international collaboration in anti-human trafficking” – in charge by Ministry of Public Security

  5. 1- Policy • At Central level • Establish the Steering Committee on National Defense and Anti-TIP, headed by (former) Deputy Prime Minister (present Minister of Police) and 14 leaders of concerned Ministries as members (herein after referred to as 130/CP Steering Committee) • Set up the Operation Regulation of the Steering Committee • Ministry of Public Security is assigned to be Standing Office of the Committee • At local level: Local Steering Committee is established as well, headed by President of People’s Committee, and leaders of concerned Departments as members. Operation regulation is set up. • Joint circular issued by Ministry of Finance – Ministry of Labor, Invalids and Social Affairs, providing guidelines on the implementation of policies on supporting returnees • Joint circular issued by Ministry of Public Security – Ministry of National Defense – Ministry of Foreign Affairs – Ministry of Labor, Invalids and Social Affairs, providing guidelines on Victim Identification, Reception and Supporting for Re-integration of returnees • Ministry of Labor, Invalids and Social Affairs issued the Circular on Guidelines on the establishment of Centers for supporting victims

  6. 2009 – 2011: 1369 cases of human trafficking, in which 2001 traffickers, 2261 victims, with details as below: 2009: 395 cases/748 traffickers /869 victims 2010: 429 cases/ 683 traffickers / 671 victims 2011: 454 cases/ 670 traffickers/ 821 victims Compared to 2010, total cases increased 5.8%, traffickers decreased 1.9% and victims increased for 22 people. Hot provinces where human trafficking occurs the most: Lao Cai (31 cases in...), Nam Dinh (18 cases in...), Lai Chau (17 cases in...), Lang Son (16 cases in...), Ha Giang (16 cases in...). Most of these provinces are located in the North of Vietnam, are mountainous areas and borders with Cambodia, China... 2-General situation on human trafficking

  7. 2- General situation on human trafficking • Human trafficking in Vietnam is becoming more and more complicated, also hard to face up with: • Under various forms • Increasing trend with more serious nature • Larger scale, occur nationwide, and crossing border • More sophisticated and foxy tricks of human trafficking • Victims of human trafficking • Women and children, who are trafficked for sexual & labor exploitation, forced marriage, adoption etc. • Teenagers who dream of pursuing better life in short time • Recently, men are also trafficked • Domestic cases are discovered these days • Marriage matching between Vietnamese women and foreigners are becoming more complicated in Ho Chi Minh city and some other provinces in Southern of Vietnam

  8. 3- Prevention Measures Ministry of Public Security Social prevention Professional prevention Pay attention to collecting information and related documents esp. for cases where women & children are absent from hometown, also suspicious criminals Enhance utilization of high-technique methods in investigation and information collection etc. Focus on monitoring household, number of citizens in areas, esp. those who leave for other provinces. Keep monitoring strictly immigration Collaborate closely with Border Guard for monitoring the border areas Enhance investigation in order to eliminate trafficking rings: Investigate thoroughly Apply strict sentence to criminals Develop international cooperation Ministry of Labor, Invalids and Social Affairs Keep monitoring employment services, esp. labor exporting and foreign labor recruitment in Vietnam Strengthen communication and awareness raising activities for the community, enhance trafficking prevention skills, esp. for vulnerable group of women and children Provide jobs

  9. 3- Prevention Measures Border Guard Purposes of prevention: Eliminate social facts that are causes of human trafficking Prevent human trafficking, discover cases timely and apply strict sentences to criminals Educate criminals and help them become helpful to the society Prevention measures Social prevention Communicate and educate, raise awareness of ethnic minority community in border areas. Participate in social – economic development of the border areas which contributes to the enhancement of living condition and creation of jobs for women in the areas Participate in strengthening the local politic system of border areas Professional prevention Keep monitoring strictly the situation of border areas, esp. hot areas Implement chronically professions Enhance patrolling and monitoring strictly people and transportation means who travel acress the borders Actively set up and implement plans for human trafficking prevention in the areas

  10. 3- Prevention Measures Women’s Union 1. Communication activities Have documentary films on anti-TIP broadcasted through Vietnam Television and Vietnam radio Have articles on anti-TIP posted on Website of Central Women’s Union and other newspapers Conduct direct communication at community and distribute pumphlet etc,. Set up models of anti-TIP 2. Help high-risk groups and returnees with their social re-integration Provide vocational training and jobs to high-risk groups and victims Provide loans to women of high-risk groups, trafficked victims, and those who return from forced marriage

  11. 4- Challenges and Solutions Repatriation – Reception of victims Ministry of Public Security Challenges Difficulties in collecting related information and evidences in order to identify victims, also to issue identification paper for their return The in-cooperation of returnees due to their depression causes difficulties for investigation, also they are afraid of the revenge of traffickers Solutions Develop the standard process for conducting related procedures for victim identification, support and protection. Pay attention to those who return from abroad. Secure personnel information of victims, protect victims from being harmed or threatened Provide legal support and apply social policies to victims timely which enable victims to reach better physical as well as psychological condition, re-integrate well into the society.

  12. 4- Challenges and Solutions Repatriation – Reception of victims Border Guard Challenges Not yet shelter or reception house for victims at Border Guard station Initial skills such as psychological, legal or medical etc. skills are not yet good enough Solutions More closely and timely collaborate with MOLISA / DOLISA / centers under DOLISA to send victims to social protection centers Make proposal to the Government, also call for support of NGOs in establishing reception house, shelter for victims at focal stations Provide training for strengthening initial skills for officers

  13. 4- Challenges and Solutions • Repatriation – Reception of victims • MOLISA • Challenges • Much difficulties in collecting exact number of returnees. • Capacity, awareness of officers responsible for victims identification, reception and supporting at some local provinces do not yet meet requirement. • Infrastructure has not yet met the requirement for reception (accommodation, hygiene condition, medical condition etc.; also daily allowance support for victims is still too limited) • Solutions • Vietnamese Government is going to approve the Decree on regulations for medical service agencies, supporting regime, and procedures for victims supporting • MOLISA is going to develop the Project on victims reception, identification, protection and supporting in order to enhance the efficiency of supporting services, also facilitate more the victims with stable jobs and social re-integration

  14. 4- Challenges and Solutions • Repatriation – Reception of victims • Women’s Union • Challenges • Communication and propagandization on anti-TIP have not yet been done throughout the communicaty • Capacity and awareness of some responsible officers are still limited, esp. those who are at local provinces • Awareness of community in general and women in particular, esp. those at mountainous areas are still limited • Most of victims and their families are afraid of being revenged by traffickers and criminals, which makes them hesitate to collaborate with officers for investigation • Social-economic situation, limited living condition and other social issues are also causes of human trafficking • Solutions • Implement comprehensively and synchronously (multi-sector) communication and propagandization on anti-TIP • Provide continuous training to enhance capacity of officeres, reporters, and communicators at all levels • Develop the volunteer network at grassroot level • Call for support of all the community for anti-TIP, victims and witness protection

  15. 4- Challenges and Solutions Victims supporting Medical support Social support Challenges Most of victims, esp. those who were sexually abused hesitate to tell their stories and the truth to the social workers, which cause difficulties for psychological treatment The discrimination of the community against victims Solutions

  16. 4- Challenges and Solutions • Legal support • Re-integration support • Challenges • Limited financial budget which causes difficulties in implementing vocational training and creating jobs for victims, hence, the re-integration of victims has not been ensured stably. • Even, there are irresponsibilities in allocating the supporting budget for the victims at some local provinces • Solutions • MOLISA is now working on the “Regulations of minimum standards for supporting victims” and will have this contributory legally to victims supporting and protection • Monitor the allocation of financial support for victims at local provinces, also integrate such support into social security programs, also monitor the support for conducting surveys on returnees focusing on high-risk groups, therefore, timely support the social re-integration

Some issues we would like to discuss and learn in this training…. • how the different departments and agencies cooperated. • How they decided on who would do what, when and how. • The situation of foreign laborers working in your country, especially of Vietnam people? • Current situation of the marriage of Vietnamese women to get married in recent years? Laws in your country regulations for marriage problems like elements, especially the responsibilities of marriage brokers with foreign elements?
