Description & Environmental Issues Affected • Water is relied on for drinking, recreation, manufacturing, energy development, agriculture, commercial fishing, tourism – and thus, one of the nation’s most valuable resources • Reduced pollution in streams, lakes, rivers, and wetlands • Protects human health and water quality • Focused on protection of smaller waters that feed into larger ones, to keep downstream water safe • Will not extend federal protection to any waters not historically protected under the Clean Water Act • Monitors public drinking water, aircraft drinking water, and pollutants from various sources entering the water

Agency/Group Regulating Act • US Environmental Protection Agency (EPA) • EPA proposed to require CAFOs to submit information on only 5 out of 14 items addressed in the settlement, including: • Type of facility • Number and type(s) of animals • Whether the CAFO land applies CAFO waste • Available acreage for land application • Whether the CAFO has a NPDES permit
