  2. What is a CMV? • GCWR 26,001 or more lbs. with towed unit of more than 10,000 lbs. GVWR • GVWR 26,001 or more lbs. • Designed to carry 16 or more passengers, including driver • Any size placarded for hazardous materials

  3. What Criteria Meets DOT Post Accident Testing

  4. Loss of human life Citation + injury requiring off site medical treatment Citation + one or more vehicles towed Post-Accident Testing

  5. Alcohol testing should be administered within 2 hours, but absolutely no later than 8 hours after the accident. If this testing cannot be done, there should be written documentation stating why tests could not be performed. Post-Accident Testing (cont.)

  6. But Remember……. An accident may meet criteria for non-DOT post-accident drug and/or alcohol tests even if it does not meet DOT testing criteria!

Non-DOT Post Accident Testing: Criteria to conduct a non-DOT post accident drug test: • Accident results in property damage of ≥ $1500; • One or more of the individuals involved require(s) off site medical treatment; • A fatality occurs; or • Reasonable suspicion exists. Vehicular accidents: • One or more of the vehicles involved are towed from the scene; • The associate receives an at-fault citation for a moving violation arising from the accident; • One or more of the individuals involved require(s) off site medical treatment; • A fatality occurs; or • Reasonable suspicion exists. Criteria to conduct a non-DOT post accident alcohol test: • Any of the above criteria are met and reasonable suspicion exists that the associate is under the influence of alcohol.
