New EP Rule Staffing analysis Due in December 2012 Ensure adequate staffing particularly during hostile action event ETE updates Due in December 2012 Supports new PAR strategy Must wait 180-days before using and submitting to State NRC currently completing “completeness” review HAB Exercise Part of requirement for more challenging exercises Shouldn’t be confused with FoF exercise Must be completed by end of 2015 Will initiate new 8-year exercise cycle.

Revision should focus on technical basis, such as dose estimate and making the modeling more realistic Spent fuel pools/storage health and safety needs to be addressed Emergency planning zone (EPZ) size needs to be increased Revision should include broad enough language in order to maintain flexibility for incorporating new technology Time limits should be removed so that reasonable protective action recommendations (PARs) can be created Concerns that first responders may abandon their responsibilities in the face of a radiological emergency Offsite response organizations (OROs) are requesting to be part of the revision/writing team, similar to what was done in the 1990’s during program strategic reviews NUREG-0654/FEMA-REP-1 -Feedback

Decommissioning Reactors • Recent decommissioning activities for two plants • Crystal Rivers 3 • Kewaunee • Cost considerations • CR3 needed repairs to containment dome • Exemption required before changes are made to EP • Exercise may still have to be conducted • Three approaches: DECON, SAFESTORE, or ENTOMBMENT

Waste Confidence • Waste confidence decision - Generic determination the spent nuclear fuel can be safely stored without environmental impacts. • Support NEPA analysis for certain licensing actions (e.g., new reactors) • June 2012 DC Circuit Court rule WC Decision did not satisfy NEPA requirements • Commission has suspended all licensing decisions that relies on WC • New WC Decision expected in fall of 2014
