  2. Current Application ReviewProcess for All Methods

  3. New Application Review Process For: Product applications that rely upon a product certification mark or listing from an approved certification agency

  4. HB 663- Certification Method Only • 553.842 Product evaluation and approval: • An application for state approval of a product under certification method must be approved by the department after the commission staff or a designee verifiesthat the application and related documentation are complete.

  5. HB 663- Certification Method Only – continue • This verification must be completed within 10 business days after receipt of the application. • Upon approval by the department, the product shall be immediately added to the list of state-approved products maintained by the BCIS.

  6. HB 663- Certification Method Only – continue • Approval by the Department shall be reviewed and ratified by the Commission’s program oversight committee except for showing of good cause that a review by the full commission is necessary.

  7. HB 663- Certification Method Only – continue • The Commission shall adopt rules providing means to cure deficiencies identified within submittals for products approved under this paragraph.

  9. Resolving Deficiencies • For the purpose of curing deficiencies identified within product applications approved by DCA

  10. Resolving Deficiencies - Continue If a comment is received on a Department approved Product, the Administrator shall immediately evaluate the comment and determine whether the comment is technically significant; If the comment as determined by the Administrator is technically significant, the Administrator shall post the comment received in the comment box for the application;

  11. Resolving Deficiencies - continue • The Administrator shall immediately notify the manufacturer of the comment received on his or her application requesting that the manufacturer respond to the comment and revise the application as deemed necessary;

  12. Resolving Deficiencies - continue • An outstanding comment(s) shall be subject to review and determination by the POC except for a showing of good cause that a review and determination by the full Commission is necessary.

  13. Resolving Deficiencies - continue • Technically significant means in accordance with this rule and or the applicable provisions of the Florida Building Code.

  14. The Key to Getting Approval in 10 days • Complete Application • Complete and correct Validation

  15. HB 663 - Evaluation Entities • Limits evaluation entities to the following: (1) The National Evaluation Service (NES); (2) The Miami-Dade County Building Code Compliance Office Product Control Division; (3) The International Code Council, International Evaluation Services (IES); (4) The International Association of Plumbing and Mechanical Officials Evaluation Service (IAPMO); (5) Architects and engineers licensed in this state.

  16. HB 663 - Evaluation Entities - Continue • Revise the list of approved evaluation entities deleting obsolete provisions governing evaluation entities. (1) The International Conference of Building Officials Evaluation Services (ICBO ES) (2) The Southern Building Code Congress International Evaluation Services (PST ESI).

  17. HB 663 - Evaluation Entities - Continue • Remove Commission authority to approve Evaluation entities by Rule. • Evaluation entities can only be approved by amending Florida Statutes. • PA rule will be revised to remove criteria for approving evaluation entities.

  18. Timeline Time line for updating Rule 9N-3 based on HB 663: • Discuss and draft proposed rule revision June 7-8, 2010 • Hold rule workshop August 10, 2010 • Hold rule hearing Sept 21, 2010 • Effective date November 1, 2010
