  2. 2005 Oregon Legislature created the Multimodal Transportation Fund to invest in air, marine, rail, and public transit infrastructure improvements. History The Fund is part of what is known as the ConnectOregon program, providing grants and loans to non-highway transportation projects that promote economic development in Oregon.

  3. History Grants and loans may not be made for transportation projects that could constitutionally be funded by revenues described in section 3a, Article IX of the Oregon Constitution. (Highway projects)

  4. History Each round of ConnectOregon approved separately by the Oregon Legislature.

ConnectOregon V Legislative Authority - SB 5533: Authorizes $42 million of lottery funds for ConnectOregon - SB 260: Authorizes eligibility of Bicycle and Pedestrian projects. - HB 5008: Requires ODOT to withhold funds until project completion and receipt of project performance measure report.

  11. ConnectOregon V Eligible Applicants • A Public Body or Person within Oregon. • Applicants who are current on all state and local taxes, fees, and assessments. (Certification required) • Applicants with sufficient management and financial capacity to complete a project.

ConnectOregon V Eligible Applicants - A Railroad Company may not receive ConnectOregon funds if the railroad company: Charges a landowner for an easement to cross a railroad that is necessary for the landowner to access the landowner’s property; and Is located wholly within Benton and Linn Counties.

ConnectOregon V • Eligible Applicants • - Does not apply to a railroad company that was imposing and collecting the charge before January 1, 2013. • - Should a railroad company charge the aforementioned easement fee after receiving a grant or loan, ODOT may not make any future grants or loans from ConnectOregon that would benefit the company.

  14. ConnectOregon V Projects must: • Be a Transportation Project. A Transportation Project is a project that involves one or more of the following modes of transportation: air, marine, rail, public transit, or Bicycle/pedestrian. The term includes, but is not limited to, a project for capital infrastructure and other projects that facilitate the transportation of materials, animals or people.

ConnectOregon V Projects must: • Assist in developing a multimodal transportation system that supports state and local government efforts to attract new businesses to Oregon or that keeps or encourages expansion of existing businesses. • Qualify for funding from lottery proceeds. • Be feasible (costs, timelines, permits) • Not rely upon continued subsidies from ODOT for operations. • Not be eligible for funding from the State Highway Trust Fund.

  18. Applications Solicit information that addresses 5 statutory consideration. Allow broad cross-section of applicants to apply without requiring involvement of consultant or extensive data gathering. Released October 7, 2013. Deadline submission November 25, 2013.

  19. Staff Review Eligibility and completeness: Program staff Feasibility: Rail, marine, aviation, transit and bike/ped staff Economic Benefits: ODOT economist and Oregon Business Development Department staff Projects assigned tiers based on ability to meet legislative considerations.

Staff Review Tiering To thoroughly meet a consideration, a project needs to demonstrate it would accomplish the intent of the consideration through application responses and independent verification. Tier 1 – The application demonstrates the project meets all five considerations thoroughly. Tier 2 – The application demonstrates the project meets most considerations thoroughly. Tier 3 – The application demonstrates the project meets some considerations thoroughly. Tier 4 – The application fails to demonstrate the project meets any of the considerations thoroughly.

Review Committees - 6 modal committees Aviation, Bicycle/Pedestrian, Marine, Rail, Transit, Freight (February 3 - March 21 2014) - 5 regional committees ConnectOregon Regions (March 31 – May 16, 2014) - 1 Final Review Committee Representatives of each modal and regional committee (June 2014) - Final approval by Oregon Transportation Commission(August 2014) (Funds available September 2014)

ConnectOregon Administration Grant Agreement - Applicants have 180 days from time of grant/loan award to sign an Agreement with ODOT. - An “Acknowledgment of Assistance” is required to be filed against project property with appropriate county clerk. The Agreement indicates that funds have been received from ODOT for improvements and that the project will continue to be operated, maintained, and serve the purpose for which the grant funds were provided for 20 years.

  24. ConnectOregon Administration - ConnectOregonis a reimbursement program. Applicants submit reimbursement request and receive designated payment percentage based on grant application match percentage. - Project costs that were paid for by the applicant prior to the agreement effective date can be used as part of the match, but are not eligible for reimbursement.

  25. ConnectOregon Administration - Beginning with ConnectOregon V, reimbursement requests will have five-percent (5%) of grant amount withheld as retainage and released to grant recipients as the following conditions are met: (a) Eighty-percent (80%) of retainage will be released to recipient upon final project acceptance by the ODOT Program Manager. (b) Twenty-percent (20%) of retainage will be released upon receipt and approval by the ODOT Program Manager of a project report that describes project performance measures and jobs retained or created

  26. ConnectOregon Administration Grantee Obligations - Grant recipients will be expected to complete the entire scope of their project as presented in their application and approved by the OTC. Applicants who fail to meet the terms of project completion as defined in their ConnectOregon project agreement will be required to reimburse ODOT for funds received. - It is the responsibility of the recipient to fund budget overruns. ODOT will not provide additional funding to applicants once projects are awarded.

  27. ConnectOregon Administration Grantee Obligations - Grantees will be required to submit monthly project progress reports to ODOT. - Grantees will be required to follow and adhere to all applicable local, state, and federal permitting and constructions laws. Additionally state rules and procedures related to wage requirements (BOLI), procurement, etc are required.
