  2. Role of the Board • Understand the bargaining process from a management perspective. • Understand the programmatic and financial impact of proposals being considered. • Provide direction to the Superintendent and Chief Negotiator.

  3. Role of the Board • Monitor the bargaining process. • Conduct a legislative hearing if necessary. • Ratify the contract.

  4. Chapter 447.605 – Public Meetings and Records Law Public Records • All work products developed by the public employer in preparation for negotiations, and during negotiations, shall be confidential and exempt from the provisions of s. 119.07 (1).

  5. Chapter 447.605 – Public Meetings and Records Law Sunshine Law • The collective bargaining negotiations between a chief executive officer, or his or her representative, and a bargaining agent shall be in compliance with the provisions of s. 286.011.

  6. Chapter 447.605 – Public Meetings and Records Law Executive Sessions • All discussions between the chief executive officer of the public employer, or his or her representative, and the legislative body or the public employer are closed and exempt from the provisions of s. 286.011.

  7. Executive Sessions Who participates? • Board Members • Superintendent • Chief Negotiator • School Board Attorney • Finance Officer

  8. Executive Sessions – Dos and Don’ts Do • Review work papers thoroughly. • Raise questions with the superintendent and chief negotiator. • Reach consensus.

  9. Executive Sessions Don’t • Discuss work papers outside of the session. • Share the discussion outside of the session. • Discuss salaries and benefits for managerial/confidential employees. • Discuss budget issues unless they are directly related to negotiations.

  10. Chapter 112.313 – Standards of Conduct for Public Officers • Board members may not disclose or use information which is not available to the general public for personal gain or benefit.

  11. Chapter 112.317 – Penalties • Removal from office • Suspension from office • A civil penalty not to exceed $10,000
