  1. Informing ED’s Response to the Presidential Memorandum on “Administrative Flexibility, Lower Costs, and Better Results for State, Local and Tribal Governments” Stakeholder Briefing July 14, 2011

  2. What is It? • Administration-wide effort to identify-- with our state, local, and tribal partners -- administrative, regulatory, and legislative barriers in Federally funded programs that currently prevent the efficient use of tax dollars to achieve the best results for their constituents.

  3. Directions to Agencies • Work with State, local, and tribal governments to identify the best opportunities to realize efficiency, promote program integrity, and improve program outcomes • Opportunities should include efforts to reduce or streamline duplicative paperwork, reporting, and regulatory burdens; identify administrative and statutory barriers • Seek out cross-agency collaboration

  4. Our Department-wide Ethic: Flexibility Must Deliver Outcomes • Flexibility exists in a number of Department programs (Ed-Flex, Experimental Sites) • Cross agency collaboration is ongoing • Safe Schools, Healthy Students • Promise Neighborhoods • RTT-Early Learning Challenge

  5. Our Department-wide Ethic: Flexibility Must Deliver Outcomes • Data Collection Alignment Across K-12 • MOE Transparency Initiative • Regulations Task Force • EO 13563 • Presidential Memorandum

  6. Our Deliverables • Identify high impact areas with stakeholders • Establish preliminary plans and actions to ensure continued achievement of program results while allowing for increased flexibility • Report by end of August to the Director of the OMB

  7. Our Outreach Efforts • Meetings with Stakeholders • EdFACTS and NCES Conferences • OSEP Megaconference • Federal Register • http://www.federalregister.gov/articles/2011/07/06/2011-16901/reducing-regulatory-burden-retrospective-review-under-eo-13563 • Regulations.Gov • ESEA.Comments@ed.gov

  10. We need your input • What administrative, regulatory, and statutory requirements could be changed to help reduce costs and unnecessary burdens, spur innovation, and improve student or program outcomes? • What regulatory requirements should the Department consider waiving, subject to statutory waiver authority? • Should the Department streamline the application and approval process for waivers and, if so, how?

  11. We need your input • Where could the Department reduce current reporting requirements that are not necessary or useful in measuring program performance, facilitating data-driven program improvements, or ensuring the proper use of taxpayer dollars? Where are there opportunities to consolidate or streamline data collection or submission requirements? • How can the Department streamline or modify the procedures that we use for processing requests for waivers of maintenance-of-effort (MOE) requirements to make them more transparent and uniform across programs with MOE requirements and reduce unnecessary reporting for States?

  12. We need your input • What cross-agency flexibility or alignment is needed to allow States, local, and tribal governments to improve their early learning, workforce, and place-based efforts? (This could include consideration of how we might provide additional flexibility in such areas as performance measurement, application requirements, or uses of funds, or might encourage cross-agency funding opportunities, etc.) • What flexibility can the Department offer to help facilitate collaboration at and across State, local, and tribal levels? • Where could increased flexibility drive the most improvements in program and student outcomes?
