  3. Statutory Requirements • Health & Safety Code Section 41712 requires the ARB to conduct a technology assessment on the feasibility of establishing a standard(s) that is more stringent than the present 75% VOC standard • Standard(s) must represent best available retrofit control technology

Statutory Requirements • Health & Safety Code 41712 requires all consumer product regulations to be: • technologically feasible • limit is already being met by at least one product • limit can be reasonably met in a timeframe provided through additional development efforts • commercially feasible • maintain basic market demand for a product category

NPCA Proposal NPCA Proposal cont’d • Definition of special purpose adhesives: “adhesives for demanding uses for mounting or special substrate applications…” Where mounting application adhesives are defined as: “an aerosol adhesive intended primarily for use in mounting photographs, artwork, and any other drawn or printed media to a backing (paper, board, cloth)”

NPCA Proposal NPCA Proposal cont’d • Definition of special purpose adhesives: “adhesives for demanding uses for mounting or special substrate applications…” Where special applications include: a. flexible vinyl, polysytrene based plastic materials incl. polystyrene foam, Sytrofoam, and polyolefins b. auto headliners, auto bonding rubber to rubber/metal where high temp, strength and chemical resistance are req’d c. cabinet and countertop touchup/repair, edge bonding”

NPCA Proposal NPCA Proposal cont’d • Definition of other mist (particle) sprays: “an aerosol adhesive which delivers a particle or mist spray, resulting in the formation of fine, discrete particles that yield a generally uniform and smooth application of adhesive to the substrate. The spray pattern must be a solid mist, conical mist or fan spray pattern.”

NPCA Proposal NPCA Proposal cont’d • Definition of other web (lace) sprays: “an aerosol adhesive which delivers a spray resulting in a non-uniform pattern of adhesive applied to the substrate which resembles a spider’s web. Web spray aerosol adhesives are generally applied to the substrate in a fan pattern.”
