4. 4 What Counts as Instructional Time? Pupil personnel services. Opening exercises, homeroom, & supervised study halls. Assemblies, clubs, student councils & similar activities during school hours. 5. 5 What Counts as Instructional Time? Educational trips accompanied by certificated school employee (admission is not charged to students or parents). Civil defense, fire & similar drills. Kindergarten orientation activities, snack time & play time if part of the curriculum.

6. 6 What Counts as Instructional Time? For graduating seniors, up to three days for graduation preparation within 60 days of commencement ceremony. Early dismissal/delayed opening due to inclement weather.

7. 7 What Does Not Count as Instructional Time? Lunch. Recess & passing to classes. Early dismissal/delayed opening for other than inclement weather. Teacher meetings for routine matters. 9. 9 Section 1504 Act 80 Exception Section 1504 of the Pennsylvania Public School Code, as amended by Act 80 of 1969, allows an LEA to request an exception to the 180 day requirement as long as the minimum number of instructional hours are met.

10. 10 Why Do You Have Act 80 Days? The purpose of Act 80 is to allow local education agencies (LEAs) to shorten their school day or school year for activities that will improve the educational program.

15. 15 When Do You Submit Act 80 Requests? After the School Board approves. Prior to the date of the activity. However, requests will be considered for approval if submitted by July 31 following the end of school year. 16. 16 Will LEAs Request Act 80 Exceptions in PIMS? No. For school years 2009-10 and 2010-11, Act 80 requests will continue to be submitted electronically in CAD (Child Accounting Database). LEAs will be notified if/when there are any changes to this process. 17. 17 How Does PDE Approve Act 80 Requests? PDE reviews requests submitted in CAD. If there are any questions, the LEA is contacted via phone or email. After the request has been approved, PDE emails the CAD contact. Most common question--kindergarten schedule if it does not seem to match your elementary form. E.g., if elementary will lose 15 hours for planned shortened days or Act 80 early dismissals, but AM and PM kindergarten when added together will lose only 8 hours. Entering a comment explaining why elementary loses more time would be helpful. Make certain CAD contact info is always up-to-date. If not, you might not receive electronic communications from the Child Accounting Office. Most common question--kindergarten schedule if it does not seem to match your elementary form. E.g., if elementary will lose 15 hours for planned shortened days or Act 80 early dismissals, but AM and PM kindergarten when added together will lose only 8 hours. 18. 18 What If You Need to Revise Approved Forms? Approved Act 80 forms are ‘read only.’ If you need to revise, contact PDE to return the forms in CAD. Do not create ‘New’ forms. After you revise/resubmit enter a comment telling us what you revised. “Read only” means “locked” -- cannot edit.“Read only” means “locked” -- cannot edit.

19. 19 Pre-Kindergarten Act 80 We will ask if you are receiving Pre-K Counts funding. If funded 100% by Pre-K Counts, we will ask you to delete the pre-kindergarten Act 80 request(s).

20. 20 Act 80 for Alternative Education for Disruptive Youth (AEDY) Programs If less than 990 hours, we will contact PDE AEDY program staff to verify. If the Act 80 request (PDE-4085) does not conform to PDE program approval or no programs have been approved by PDE, the request will be denied.

21. 21 What if You Have a Strike? “. . . Act 80 days approved by the department (except those approved as early dismissals), including those that have already occurred, will be rescinded upon initiation of a work stoppage.” As soon as we become aware that a strike has begun, we check to see if the district submitted Act 80 requests. 23. 23 Completing the “PDE-4085 Request for Section 1504 (Act 80) Exception” Must have an e-PDE Web Portal ID & password. Must be registered to use the CAD application. Log into the e-PDE Web Portal. Select CAD/Production/School Year.

37. 37 Entering Comments Enter comments as needed. E.g., modified kindergarten during early dismissals. How? Just click on “COMMENTS” below the name of the LEA on any CAD screen.
