Purpose
PURPOSE

This slide show is provided to update the knowledge of DHS social workers and supervisors. It contains an overview of court unit procedures.

If you have specific, case related questions please contact your supervisor, court representative or solicitor.

COURT UNIT

  • The court unit is located on the 4th floor of 1515 Arch St.

  • Court representatives will present most court cases for DHS social workers in family court.

  • Court reps at the court desk will obtain restraining orders and represent DHS in delinquent hearings.

  • DHS social workers will need to attend detention, adjudicatory, termination and contested hearings.

  • Court sheets are required to be in the court unit at 9AM the day before the hearing. If court sheets are not on time you will need to represent yourself in court.

  • If a social worker is required to appear at a hearing they must be on time. This is especially important in Model Court.

  • Read the previous court order and ensure that you have completed the order well before the next hearing date.

  • Address safety by visiting children in placement and at home

  • Submit your court sheet early and speak to the court rep directly on current issues and any conflicts.

  • Conference with the solicitor for hearings that are contested, adjudicatory or moving toward termination.

  • If you’re appearing in court, notify the court rep and be prepared to answer specific questions.

  • Placement cases require a review using the ASFA criteria. If a child has been in care for over six months, prepare to present a compelling reason to continue the placement.

  • Call the provider agency for an update and ask if they can attend. Compile data needed for the court sheet.

  • NOTIFY PARENTS, FOSTER PARENTS, KINSHIP PROVIDERS AND CONTRACT AGENCIES OF THE DATE , TIME AND LOCATION OF THE COURT HEARINGS.

  • COURT SHEET MUST ARRIVE BEFORE 9 a.m. THE DAY BEFORE THE HEARING OR YOU MUST REPRESENT YOURSELF IN COURT

    • SUBMIT THE LAST TWO YEARS OF COURT SHEETS.

    • ADDRESS THE REASON THE CASE IS IN COURT.

    • REVIEW THE PREVIOUS COURT ORDER AND INDICATE WHETHER YOU HAVE COMPLETED THE ORDER.

    • PROVIDE CURRENT INFORMATION REGARDING THE FAMILY’S PROGRESS MEETING THE GOALS OF THE FSP, AND THE FSP DATE.

    • PROVIDE THE CORRECT (AFS) ACCEPT FOR SERVICE DATE.

    • IDENTIFY THE LOCATION OF CHILDREN PLACED IN ‘OUT OF HOME CARE’.

  • OUTLINE THE DHS RECOMMENDATIONS

  • THE SUPERVISOR IS TO REVIEW, MAKE CORRECTIONS AND INITIAL THE COURT SHEET

  • CONSULT WITH THE COURT REP AND SOLICITOR

  • ADMINISTRATORS AND DIRECTORS WILL BE NOTIFIED OF COURT SHEETS SUBMITTED LATE OR NOT SUBMITTED

  • PROVIDE PARENTS WITH PERMANENCY LETTER , PLACEMENT BROCHURE AND A VISITATION SCHEDULE

  • PREPARE SHELTER CARE PETITION WITH THE LEGAL ASSISTANT WITHIN 24 HOURS OF THE VPA

  • AN ADJUDICATORY HEARING WILL BE HELD W/I 30 DAYS

  • CONTACT THE COURT DESK AT 686-7224 TO OBTAIN A RESTRAINING ORDER DURING WORK HOURS.

  • PROVIDE PARENTS WITH PERMANENCY LETTER, PLACEMENT BROCHURE AND SETUP VISITATION

  • PREPARE THE PETITION WITH THE LEGAL ASSISTANT WITHIN 24 HOURS AFTER THE DETENTION HEARING

  • AN ADJUDICATORY HEARING WILL BE HELD WITHIN 10 DAYS

    • PERMANENCY HEARING - 6 MONTH REVIEW

The order
THE ORDER

  • THE JUDGE’S ORDER WILL BE RECORDED ON THE HEARING & ORDER (FORMERLY THE DRO) AND THE COURT SHEET. BOTH DOCUMENTS WILL BE RETURNED TO THE SUPERVISOR AFTER THE COURT HEARING.

  • THE JUDGE WILL MAKE A FINAL DETERMINATION WHETHER DHS MUST MAKE CONTINUING EFFORTS TO REUNITE THE FAMILY IF AGGRAVATED CIRCUMSTANCES EXISTS.

  • IF YOU DISAGREE WITH THE ORDER OF THE COURT CONSULT YOUR SUPERVISOR AND ADMINISTRATOR TO DISCUSS THE ISSUE. ASK THE SOLICITOR IN COURT TO PLACE THE OBJECTIONS ON THE RECORD.DO NOT IGNORE THE ORDER.

  • IF YOU DO NOT RECEIVE THE HEARING AND ORDER (DRO) OR COURT SHEET CONTACT THE COURT REP IMMEDIATELY.

  • PETITIONS ARE FILED BY YOUR ASSIGNED PARA-LEGAL IN THE SOLICITORS OFFICE (16TH FLOOR).

  • IF YOU DO NOT FULLY UNDERSTAND ASFA SPEAK TO YOUR SUPERVISOR/ ADMINISTRATOR.

  • EARLY RELISTS CAN BE REQUESTED BY COMPLETING THE FORM LOCATED IN THE COURT UNIT AREA
