Public Input Opportunity for IDEA Reauthorization Open Through March 14 • The federal IDEA law was last reauthorized in 2004 and may be reauthorized during the 130th Congressional session. • To ensure Ohio's issues and concerns are at the forefront of any federal legislative review, the SBE plans to develop and advocate on a set of recommendations for the reauthorization of IDEA in 2013. • Please send recommendations and suggestions to ideaplatform@education.ohio.gov by Thursday, March 14, 2013. 

  4. Operating Standards for Education Agencies Serving Children with Disabilities • ODE is reviewing the operating standards and collecting public comments and feedback.  • The feedback of the disability community stakeholders is an important part of this process.  • ODE/OEC facilitated Regional Feedback Forums on the Operating Standards. • Draft 2 of the “rules” is now posted on the ODE website. • Keyword: “Revision of the Operating Standards”

  5. Positive Behavior Interventions and Support and Restraint and Seclusion Policy • Approved by the State BOE in January to create a learning environment that promotes the use of evidence-based behavioral interventions , thus enhancing academic and social behavioral outcomes for all students • The proposed rule must now go to the Joint Committee on Agency Rule Review (JCARR) for a hearing • Once the JCARR process is finished, the rule comes back to the State Board for a final vote in April. • The rule and policy will be effective for the 2013-2014 school year and can be found on the ODE website using the keyword search "ODE Policy PBIS".

Parental Consent Requirements - Access to Public Benefits or Insurance • Federal amendments to Part B of IDEA effective March 18, 2013 • parental consent requirements a public agency must meet before it may access for the first time a child’s or parent’s public benefits or insurance (e.g., Medicaid) to pay for services required • ensure that parents of children with disabilities are specifically informed of all of their legal protections when public agencies seek to access public benefits or insurance (e.g., Medicaid) to pay for services • address the concerns that requiring parental consent each time access to public benefits or insurance is sought, in addition to the parental consent required by the Family Educational Rights and Privacy Act (FERPA) and section 617(c) of the IDEA, imposes unnecessary costs and administrative burdens for LEAs

Parental Consent Requirements - Access to Public Benefits or Insurance • ODE-OEC will share guidance for implementation of this new provision in the near future. While the federal regulations are effective on March 18, 2013, OSEP has determined that states have time to develop appropriate implementation guidance for the SEA and LEAs with full implementation to be effective by July 1, 2013.

Early Learning and School Readiness • SBOE adopted the Early Childhood Standards • Next steps-developing model curricula and curriculum alignment tool • Step Up To Quality-Program Standards • Many comments received which are being reviewed. • Teacher Evaluation System • Providing guidance around Early Childhood and will be creating a guidance document.
