The International Milieu • UN Declaration on Human Rights (10 December 1948) • Article 25 (1): • Everyone has the right to a standard of living adequate for the health and well being of himself and of his family, including food, clothing, housing, and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control • International Covenant on Economic Social and Cultural Rights (ICESCR)[16 December 1966] • Article 11 (1): • The States parties to the present Covenant recognize the right of everyone to an adequate standard of living for himself and his family, including adequate food, clothing and housing, and to continuous improvement of living conditions. The States parties will take appropriate steps to ensure the realization of this right, recognizing to this effect the essential importance of international cooperation based on free consent.

  14. The 1987 CONSTITUTION • Section 9, Article XIII on Social Justice and Human Rights: The State shall by law, and for the common good undertake, in cooperation of the private sector, a continuing program for urban land reform and housingwhich will make available at affordable cost, decent housing and basic services to the underprivileged and homeless citizens in urban centers and resettlement areas. It shall also promote adequate employment opportunities to such citizens. In the implementation of such programs, the State shall respect the rights of small property owners.

  15. Statutes • The Local Government Code (RA 7160, Jan 1, 1992) • Section 17 (a) essentially provides: Local government units were encouraged to be self-reliant and to continue exercising the powers and discharge the duties and functions as are necessary, appropriate, or incidental to efficient and effective provision of basic services and facilities. Emphatically, provision oflow cost and mass housing are devolved to cities and provinces.

Roles of LGUs under UDHA • Conduct land inventory & update it every three (3) years - (Sec. 7) ; • Identification of sites and resettlement areas - (Sec. 8) ; • Acquisition of government owned and foreclosed properties for socialized housing - (Sec. 10) ; • Registration of socialized housing beneficiaries - (Sec. 17) ; • Provision of basic services in socialized housing or resettlement areas such as potable water, power and electricity, sewerage facility, access to road and other basic services and facilities - (Sec. 21)

Roles of LGUs under UDHA • In coordination with PCUP, shall afford the beneficiaries or their duly representative an opportunity to be heard and to participate in the decision-making processover matters involving the protection and promotion of their legitimate collective interest - (Sec. 23)

Related Provision from the Local Government Code (R.A. 7160) Local government units shall promote the establishment and operation of peoples and non-governmental organization to become active partnerin the pursuit of local autonomy (Sec. 34). Local government unit may enter into joint venture and such other cooperative arrangements with peoples and non-governmental organizations to engage in the delivery of certain basic services, capability building and livelihood projects, and to develop local enterprises designed to improve productivity and income diversity, agriculture, span rural industrialization, promote ecological balance and enhance the economic and social well-being of the people(Sec. 35).
