  3. The Law • The Information and Consultation of Employees (ICE) Regulations 2004 • Employers must consult at a national level (phased) • No set method – requirements are triggered • Elected representatives • BIS cites Tesco/Usdaw as good model

  4. How to use the regulations • Is the agreement likely to improve current conditions? • Is the employer likely to to establish an agreement anyway? • No union recognition • Unsatisfactory arrangements in place • Use alongside current CB processes
