  2. Zero Reject • Means schools cannot exclude students with disabilities due to the nature or degree of their disabilities. • All students (3-21) must be located, evaluated and provided with programs. • States are also required to locate and evaluate children birth to 3.

  3. Zero Reject and Discipline • 1997 Reauthorization provided specific procedures for discipline. • Overall theme-all students, even those suspended or expelled, must be provided with FAPE. • Even students not identified can assert protection of IDEA if school had knowledge of potential disability.

  4. Potential Disability • To determine if the school had knowledge, one of the following must have occurred: • The parent of the child notified the school district personnel in writing (or orally if the parent can not write) that the child was in need of services. • The behavior or performance of the child demonstrated the need for special services.

  5. Continued... • The parent requested an evaluation of the child. • The child’s teacher or other expressed concern about the child’s behavior or performance to the special education director or some other school personnel responsible for the special education referral system.

  6. Child Find • All states must have procedures to locate unserved children and to inform parents of available services and programs for children with disabilities.
