  3. Tobacco advertising directive • Replaces Directive 1998/43/EC • Bans “direct” advertising in press • Sponsorship of cross border events • Internet advertising • Radio advertising • Comes into effect??

  4. Tobacco products directive • Replaces three existing labeling and regulatory directives • Bans terms “light”, “mild” • Increases warning label size • Provides for disclosure of ingredients • Reduces tar, nicotine and carbon monoxide levels

  5. Council Recommendation, December 2002 Non binding guidelines to member states advising countries to • ban “indirect” advertising • Restrict vending machine sales • Impose age limits for purchase of cigarettes

  6. Legal developments • December 2002 - ECJ upheld tobacco products directive • Swedish Match now challenging Community ban on “snus” or oral tobacco in 2 cases from UK and Germany • FIA challenging legality of tobacco advertising directive - Germany to follow??
