8. 700 MHz RPC Process • FCC Requirements for Regional Planning • Governor must appoint convener to hold 1st 700 mtg. • Most elements the same as the 800 Plans • Encouragement of all eligible entities to participate • Adjacent Region’s written approval • Other Considerations: • Frequency Coordination by all PS Coordinators • Funding (advertising, copying, plan preparation) • Broadcast TV/DTV Incumbency • Encourage Participation by all Eligible Entities • 60 day notice in PS publications & on PS web sites • Hold meetings in different parts of the region • Set up e-mail list servers for distribution of information KY 700 MHz RPC Region 17

9. Adjacent Regions • Notify adjacent regions of meetings • Chair should attend adjacent regions’ meetings • Pre-planning proposal • Allot a certain amount of spectrum near region borders • Use 25 kHz building blocks • Written Approvalof Regional Plan by Adjacent Region(s) KY 700 MHz RPC Region 17

10. NIJ Pre-coordination Database • 700 MHz can be coordinated by any of the FCC-certified Public Safety Coordinators • Need a common database for all coordinators and RPCs to use • Implementation Cmte recommends use of common database up to & including licensing • NIJ has approved the funding for a database and some RPC start-up expenses • NCC has asked that all RPCs and FACs be required to use NIJ database • NIJ funding tied to use of database KY 700 MHz RPC Region 17

TV Incumbency • Full Access: Can TV be moved out faster? • On-going FCC policy discussions • Kennard speech (eliminate 85%, mandatory DTV receivers, penalties) • Canadian border discussions • Will commercial carriers in 30 MHz segments help buy/push out incumbent TV broadcasters? • Does not affect adjacent channel 59 blockage • Can public safety community exert additional pressure? • Could explore potential benefits of non-standard base/mobile of PS spectrum pairing during interim • additional subscriber cost issues • creates transition issues KY 700 MHz RPC Region 17

14. TV Incumbency Rules • Protect incumbent analog and new digital TV receivers in the 746-806 MHz band until broadcast transition ends • Deadline is December 31, 2006 to end analog broadcasts • By market exceptions may be granted by FCC, such as: • Less than 85% of households are served by digital TV services (over-the-air, cable, satellite, etc.) • At least 1of 4 national TV network affiliates are not broadcasting digital • Licenses within 120 km of Canada and Mexico are subject to future agreements with those countries • Canada has allotted DTV to ALL full service, low power, and authorized (but not on-the-air) analog TV stations • many Canadian allotments in 60-69 MHz range • very few analog or digital TV stations in Mexico in 60-69 MHz range KY 700 MHz RPC Region 17

This reduces separation when Grade B contour is < 55 miles. e) Rules provide extra protection to TV/DTV sites with HAAT > 350 meters.
