  1. The Health Ministry has proposed new moves in order to regulate the booming business of surrogacy in India. According to the new proposed rules, foreign nationals who account for the maximum number of customers, will be barred from using Indian nationals as surrogate mothers.

  2. The rules state that it will be mandatory for couples to take custody of even abnormal kids born through surrogacy. The rules will also regulate in-vitro fertilisation (IVF) clinics making them mandatory to be registered and have proper infrastructure.

  3. The proposed Assisted Reproductive Technology Regulation Bill is to be introduced in the winter session of Parliament. The bill aims to regulate assisted reproduction like surrogacy and IVF. If passed, the Bill could shut doors on foreign nationals from having surrogate babies.

  4. The rules suggest that single parents will be allowed to have children through surrogates but with clauses. The Bill will also have provisions for health insurance for surrogates and ensure regular tests for surrogates.

  5. Women's activists and experts alike have lauded the Bill. "The move to get IVF clinics registered is a good one but rules should be realistic on age and number of babies," say IVF experts.

  6. The move comes soon after an Australian couple recently abandoned one of their twins born from an Indian surrogate mother. "This Bill will regulate the mushrooming ART industry and stop exploitation of surrogates. The Bill will fix minimum compensation and also the age limit," senior Deputy Director ICMR RS Sharma said.

  7. The Bill will make it mandatory for couples to sign legal documentation with the donor and give full rights of a legitimate child to the surrogate baby. With contentious aspects left on the Cabinet to approve, it remains to be seen whether the Bill will see the light of the day in Parliament.
