  2. When a doctor fails to perform his or her duty in a responsible manner and causes harm or injury to a patient, it may form the basis for a medical malpractice claim. To prove that medical malpractice occurred, you must demonstrate the following:

  3. For you to sue a doctor, you must show that a doctor-patient relationship existed between you as the patient and the medical professional you are suing. A Doctor-Patient Relationship Existed

  4. The Doctor Was Negligent You cannot hold a doctor liable for medical malpractice simply because you are unhappy with the treatment and results. To sue, you must show that the doctor acted in way that a competent doctor, under similar circumstances, would not have.
