Introduction • In 2009 Treasury introduced two income tax allowances under an Amendment Act, designed to stimulate the use of energy efficient technologies and best practices in industrial and manufacturing sectors of the economy. • These refer to Sections 12i and 12l of the Income Tax Act: 12i is designed to accelerate economic growth and support industrial policy for several factors, of which energy efficiency is one; 12l only concerns energy efficiency savings. • R20b has been allocated to the first for a period of 5 years and targets the largest companies undergoing major infrastructural changes and is administered by theDepartment of Trade and Industry. It has been going for over a year with considerable interest shown.

  4. The allowance for energy efficiency savings 12l • These regulations are targeted to be implemented in 2012. Supplementary guidelines are to be written in addition to the Regulations which should be clear but more detailed. • The intention is to target all levels of industry for 20 years with a rebate formula (to be announced by Treasury) that makes it worthwhile for companies to invest in energy savings projects, while covering their costs (of measurement and verification etc). • 2 standards have been written to enable the methodology to be established, one by the SABS for the Measurement and Verification of energy savings, and one for the process of accreditation of M&V bodies (companies) by SANAS. • In each standard the certified measurement and verification professional plays a key role in determining the baseline of a client and certifying the energy efficiency savings of his project.

The allowance for energy efficiency savings 12l • The certificate and data must be submitted to SANEDI before it supplies an tax clearance form that the client can give to SARS with his annual returns. • The application and approval process is similar to 12i and the administration is carried out by SANEDI which must establish and maintain a database for SARS and Treasury scrutiny at all times. • The Income Tax Act strictly prohibits the use of “concurrent benefits” which are any credit, allowance, grant or other benefit granted by any sphere of government for any energy efficiency savings achieved through application of the same measures stated in the certificate pertaining to the project being undertaken.

Future Regulatory measures (1) • Designated users consuming >25GWh p.a, inc. to submit energy management plans with progress on identified EMOs, expansion of operations and annual savings targets as agreed • Annual energy audits for entities in the industrial, commercial and public building and transport sectors • Energy efficient practices in the design of buildings via the amended National Building Regulations and standard • Energy Performance Certificates in public buildings with a floor area >1 000m2 for existing buildings not older than 10 years • Existing dwellings to obtain a minimum 50% of hot water supply from a fully functioning solar water heater, heat pump or heat recovery system enforceable at point of re-sale

Future Regulatory measures (2) • MEP Standards/Labeling on industrial and domestic equipment • Minimum Energy Performance Standards and Labeling on electric lamps (phasing out of inefficient lamps) • Regulations, standards and labeling of light motor vehicles on fuel economy and CO2 emissions at point-of-sale • A Carbon Tax • Energy conservation regulations for the largest users of electricity
