  1. Your Family Law Attorney – Revisited When your divorce was made final and all the issues surrounding it were in place, you probably thought you had seen the last of your family law attorney. Although the divorce itself is “final”, there are a number of issues and conditions of the dissolution of your marriage that may require modification. Things can change quickly in a person’s life. When they do, you may be scheduling your appointment for a do-over with your attorney soon after the finalization of your divorce or many years down the road. Returning to an attorney who is familiar with your case can result in less time and money being spent to make the necessary changes. *Child Support –Board Certified family law attorney Cindy D. During the divorce proceedings, an Income Shares Model is used to determine how much child support is needed to match the amount that would have been spent on the child if the parents had not divorced. Once this amount is determined, it is divided between the two spouses according to their income. Although the amount of child support you have been ordered to pay or receive was appropriate at the time, a variety of factors can make it inappropriate later on. When a child develops a health condition and requires additional medical care, the need for child support increases. Diagnosis of a learning disability can also result in specialized educational needs. These are just some of the conditions that can result in the need to revisit your divorce attorney. * Child Custody–Florida child custody laws changed drastically in 2008, including the terms used to describe many of the related issues. A number of terms were eliminated including custody, custodial, non-custodial, visitation, and primary residence. Instead, the courts focus on shared parental responsibility, equal time-sharing, and majority time-sharing.

  2. The main idea behind these changes is that all parents have an equal share in the care and support of their children. They also have an equal part to play in making decisions about their children. If the courts gave you and your spouse shared responsibility, it was probably the fairest resolution at the time. But if issues have arisen that could put your child at risk or interfere with one parent’s ability to care for their child. Some things that might call for you to re-visit the family law attorney who represented you during your divorce include: A change in the physical or mental health of one parent Special need children and the way their needs are being met Cultural considerations The child’s ability to adjust to a new community and school Excessive discipline Emotional abuse Evidence that the child is being abused Drug or alcohol abuse or any kind of abuse toward the child After a certain age, the child’s wishes Revisiting the same family law attorney who was your advocate during your divorce will know you better than any new lawyer you may hire.
