  1. Common Problems in Domestic Violence Cases Domestic violence is a growing issue among most countries around the world. This requires specific attention because dealing with abuse and domestic violence, has always been a top priority of society. With this in mind, when confronted by similar situations, people tend to not always come out and try to solve the confrontation but instead, they stay exactly where they are in order to avoid any more abuse. This is nonsense which is exactly why families should know the importance of having the right lawyer by your side to assist and guide you through this difficult process. Domestic violence lawyers are the experts on this matter, therefore hiring one when things are not so clear is vital. By this I mean, that there are some scenarios in the legal system when domestic violence lawyers cannot really do much because the odds are against their favor. Abused victims should know this before proceeding. By checking all the possible scenarios and having a good game plan, the problem can be fixed.Domestic Violence Cases 1 Let us start with the problems. First of all is the insufficient evidence. In any of the three types of domestic violence cases are simple, aggravated or corporal injury, one of the top reasons for getting your case dropped is insufficiency of evidence. Domestic violence lawyers must be able to prove each element needed to identify an offense beyond reasonable doubt. For instance, lack of body injuries, lack of the victim’s credibility, any traumatic condition of the abused not caused by abuse, or even the supposed absence of offensive touching are all arguments to prove insufficient evidence. Another element is inconsistent statements. Most domestic violence lawyers will review statements done by the defendant. However, in some instances, the victim tends to make subsequent verbal statements which are different than the first one. By doing so, they are putting themselves into question at court. This seriously hurts the power of witness’ statements and victims’ testimony. A third elements is the lack of visible injuries. Previously, I commented that lack of these injuries is an important argument when it comes to lack of evidence. However, this does not necessarily mean that domestic violence took place, neither it is a requirement to charge the defendant with this charge. A simple push, a shove or even spitting in your face, are elements needed to prove harmful touching. Either way, if there are visible injuries, defendants can be charged with felony.

  2. Last but not least, we can point out the lack of independent witness. This can be a problem because in many domestic violence cases, there are no witness to the incident. Yet you should already know that this does not rule out the existence of a domestic crime. This limitation is not fatal when in court because there are many other sources of evidence as pointed out already. Either way, having the advice of a domestic violence lawyer is the key to crack this safe. Domestic violence is increasing. Hence so is the amount of family law cases of this nature. If you are affected by this problem, do not think twice and get an attorney. Only then, he/she can proceed and know if your case can or not be proven in court.
