Women Owned Small Business (WOSB) Contracting Program Overview of Women-Owned Small Business Program • Published October 7, 2010 (75 FR 62258) • SBA is charged with implementing and administering the program • Program requirements set forth in 13 C.F.R. part 127 • Allows Eligibility Exams • Explains Protest Procedures

  3. WOSB Contracting Program Overview • The Women-Owned Small Business (WOSB) program authorizes contracting officers to set aside certain federal contracts for eligible: • Women-owned small businesses (WOSB) or • Economically disadvantaged women-owned small business (EDWOSB)

WOSB Contracting Program Overview • Enable contracting officers to meet goals among WOSB and EDWOSBs ( federal government must award 5% of its prime contracting dollars to WOSBs) • Helps ensure a level playing field so WOSBs can compete for Contracting Opportunities • The program will help create and retain more jobs for WOSBs

WOSB Contracting Program Final Rule • Establishes 83 NAICS Codes eligible for Federal contracting under the WOSB Program • 45 NAICS codes which are underrepresented These are for the Economically Disadvantaged WOSB • 38 NAICS codes are substantially underrepresented which are for the WOSBs List at www.sba.gov/wosb

WOSB Contracting Program Eligibility Requirements • Women Owned Small Business • 51% unconditionally and directly owned & controlled by one or more women • Woman/Women must be U.S. Citizens • Must meet SBA size standards - www.sba.gov • Must manage day-to-day operations • Must make long term dicision for business • Must work at business full time

WOSB Contracting Program Eligibility Requirements for EDWOSBs • She has a Personal net worth less than $750,000 – assets – liabilities • Not including primary residence & value of business concerm • Income reinvested in IRA or other retirement account (Must be IRA or other official retirement account that is unavailable until retirement • Transferred assets within two years if to or on behalf of immediate family members for education, medical expenses or other essential support • Her adjusted gross yearly income does not averaged over 3 years does not exceed $350,000 • The fair market value of all her assets including primary residence and value of business deoes not exceed $ 6 million.

WOSB Contracting Program CERTIFICATIONS • Self Certification Program • must be certified by federal agency, state government or a national certifying entity approved by SBA (3rd party Certifier) or • Certify with required documentation to support self certification • Submit certification to the Repository • Must register in Central Contractor Registration (CCR) - www.ccr.gov

  9. WOSB Contracting Program • 3rd Party Certifier • Is a Federal agency, state government or national certifying entity approved by SBA • SBA will maintain a list of approved Third Party Certifiers at www.sba.gov/WOSB (future)

  10. WOSB Contracting Program • 5 Steps to participate in the WOSB Program 1. Read the WOSB Federal Contract program regulations in the Federal Register and the WOSB Compliance Guide 2. Register in CCR Central Contractor Registration as a WOSB or EDWOSB 3. Log onto SBA GLS General Login System 4. Go to the WOSB Repository 5. Represent your status in ORCA (Onlne Representation and Certifications Application

  12. WOSB Contracting Program • Register in Central Contractor registration which is a online database of companies wanting to do business with the government • To be eligible you must check the WOSB or EDWOSB Box • You must meet all the requirements of a WOSB or EDWOSB to check that box

WOSB Contracting Program • Set up GLS account - General Login System • Go to https://eweb.sba.gov/gls • If you do not have an account: • Go to the web address above • Click on ‘instructions for GLS” for information on how to request an account • Go to “Request SBA User ID” to create account • Log in to your GLS account

WOSB Contracting Program • What is the Repository • By statue, documents verifying a WOSB/EDWOSBs eligibility must be submitted to the contracting officer • The SBA created a document warehouse for theWOSBs to sumbit documents to the CO • A WOSB ‘s documents in the repository can be accessed only by WOSB, SBA and the CO once permission is allow by the firm • Once you are logged into GLS click on “Women-Owned Small Business Program Repository”

WOSB Contracting Program What do I need? • Self Certification • Birth certificates, naturalization papers, unexpired passports to verify U.S. citizenship • Copy of JV agreement (if applicable) • WOSB/EDWOSB Certification • DBA certificate • Corporate information relating to verifying ownership by woman or women • EDWOSB all of above and SBA Form 413

WOSB Contracting Program • Self Certification continued … • Copy of Joint venture agreement • LLC – articles or organization • Operating agreement and any amendments • Any additional documentation required to support • Corporations • Articles of incorporation and any amendments • By-laws and any amendments • All issued stock certificates • Stock ledger and Voting agreements, if any • Partnerships • Partnership agreement and any amendments • The assumed/fictitious name • WOSB Program Certification

ORCA What is ORCA • The Online Representations and Certifications Application is the primary Government repository for contractor submitted representations and certification required for the conduct of business with the government • Prior to submitting an offer for a contract you must represent you status in ORCA

How to Compete • Make sure you have completed the steps to participate in WOSB program • Identify contracting opportunities • FedBizOpps – https://www.fbo.gov • SBA’s Federal Business Opportunities page • www.sba.gov/content/federal-business-opportunities • Submit an offer for a contract • Grant CO access to your documents in WOSB repository

  20. WOSB Contracting Program Contracting Officer’s Responsibilities • Reasonable Expectation of 2 or More Offers by WOSBs • Anticipated Award Price must not exceed: • $5M – Manufacturing • $3M – All other

WOSB Contracting Program Contracting Officer’s Responsibility • Must check that WOSBs must have proper certification in ORCA • Must Certify he/she checked the WOSB repository that all required documents are in the system (including certifications by 3rd Party certifiers) • WOSBs will give Contracting Officers 30 days authorization to review repository documents
