  2. When you have a unique product or business name, then it is important that you protect it from infringement through trademark registration. By so doing, you protect your marketing strategy, position, and commercial advantage from being misused by unscrupulous people. Once you do so, the law considers you as the legal owner of the trade or brand name, and any other person who uses it will be infringing on the law.

  3. Application Process Trademark categories include trademarks for products or services, collective trademarks, and three-dimensional trademarks are trademark categories. The registration process is conducted via filing one application directly with the European Union Intellectual Property Office (EUIPO). The applicant should pay the fees associated with filing a European Union trademark application with EUIPO, and attorney fees if required.

The minimum information required to fill an application is: the full name and address of the applicant, the country and, if appropriate, the state of incorporation of the applicant (needed in the case of federal states such as Australia, Canada and the US), full details of the trademark, a good representation of the logo or design, if appropriate, an indication of the goods and services sold or to be sold under the trademark, and details of the application on which Convention Priority is to be claimed.

  5. One can fill up the application in English, French, German, Italian or Spanish language. You may use the option of EUIPO's Fast Track application process, which can be 50% faster than a regular application. Once you apply for registration, then you will get an application number and date, and from that date, the examination of the mark starts, and the filing receipt of the application is issued. • A European Union trademark application may be opposed within three months from the date of publication. To file an opposition, you should fill the specific form available online and should pay the official fees associated with that. • The trademark registration will ensure that no other person can use a similar, or confusing, trademark to sell their products.
