  3. Implementing Arrangments • Current I.A. • US-Brazil agreement • NASA and INPA • Expires December 17, 2004 • Cannot be extended

Implementing Arrangments • Key issues remaining - #1 • “Results of Investigations carried out under LBA may become available to the scientific community through publication in appropriate journals or other established channels as soon as possible and consistent with good scientific practices, except in cases in which the datatinvolved are identified by one Party as strategic or business-confidential... Once identified as business confidential by one Party, the other shall keep confidnetiality of the data collected untl the Coordinating Agencies, decide the approrpiate time for, respectively, their publication or commercial exploitation.”

  5. Implementing Arrangments • Key issues remaining - #2 Liability Language • State Department and Brazilian Congress Still Need to Approve ...So what do we do in the meantime??

  6. Interim Solution: One CNPq license • Summited by Brazilian institutions, signed by US counterpart • NASA continues role as providing overall coordination for PI’s participation • NASA signs as foreign partner • NASA support staff covered as one “team” • NASA will not be able to do this

  7. Interim Solution: Multiple CNPq licenses • You decide if you will continue • PIs should work with counterparts to sumbit licesnse requests • PI institution (not NASA) will sign as responsible US counterpart • INPA will sign as responsible Brazilian agency • Individual or group applications OK

Interim Solution: Multiple CNPq licenses • NASA will not be central coordinator for US participation in 2005 • NASA will still be able to provide logistics support – PROVIDED SUPPORT STAFF ARE IDENTIFIED IN THE CNPq LICENSE REQUEST • Amount/extent of NASA support in 2005 depends on how many NASA-associated teams apply for CNPq licenses • May require modification of statements of cooperation

KEY DATES for RESEARCHERS • End of August 2004 • Submit CNPq license applications • December 17, 2004 • Implementing Arrangement expires! • Individual CNPq licenses need to be in effect • OR, field research activities stop • 2005 (Dan has Details) • 3 months (+/-): exit activities for teams not continuing • NASA phase out of field activities

  10. Beyond 2005 • NASA Guest Investigator Annoucement 2006-2008 • Formalized with Implementing Arrangement • Syntheses and Integration Collaboration • Participation in Workshops/Conferences • Not intended for continued field observations
