I made a purchase on Amazon about a week ago and while I was checking out, up came this message that told me starting June 1st, 2008, Amazon would have to collect a sales tax for New York State residents. I had heard about this "Amazon Tax" a few weeks prior and was disgusted by it. Amazon has sued New York on the basis that the law is Amazon Promocodes unconstitutional; I am sure glad Amazon is fighting back. All of the articles on this that I have read mainly discuss the legality of the law and those complexities. I'm going to look at it a little differently. What does this mean for we the people? The short is that this tax is bad for us. There is rarely ever a tax that is good for us because it increases the prices of goods that we buy. I live in New York City and I buy books mainly from Amazon and Barnes & Nobles--I even have one of those B&N Member cards. I decide which retailer to use based on price and urgency. Amazon offers us a means to save money on identical products and the physical stores satisfy our urgent needs. This system is working pretty well as greedy governments get some taxes and we get to save some of our money. A better system would be one with no sales taxes at all. New York State estimates that this tax will bring in an addition $50 million. What this really means is that this law will steal an extra $50 million dollars from our wallets. There is a possibility that Amazon purchases from New York will decline a little and that $50 million may never come to fruition. I am personally torn as I love what Amazon has been able to do--offer great products and great services at low prices--but, I despise giving the state any more money. Is $50 million dollars better suited in the hands of the state or in our hands? The answer most people would give is that it is better in our hands and the science would agree. Especially in our current economic state with prices skyrocketing at the supermarket and at the pump. We the people need to keep more--if not all--of our own hard- earned money. The state is only going to end up wasting most of it, using it for useless pet projects, or funneling it to lobbyists. The net benefit to us will be negative. There are many discussions at Amazon's discussion boards about this tax and one post in particular caught my eye. It sums up the point of this tax. K. Crawford wrote, "There are a couple of posters here that must be state employees, because they want you to pay [a] tax you aren't required to pay." That is the great problem of socialism, those employed by the state will act in their best interest and in this case, it is to take money from you so that they can have a bigger paycheck--that is the point of this tax. Regardless of what laws are on the books, any laws that are not in compliance with the Constitution are void. The tenth amendment allows no state to places taxes on another state which is exactly what this law is doing. This tax is good for government. Bad for Amazon. And worst of all, bad for us.
