In the event that a property transfer is in the works, here is your simple how-to guide. Property transfers, at the broadest level can be involuntary (say, the government or courts seize and transfer against the owner’s choice to do so) or voluntary transfers. We will focus on the voluntary transfer methods. Sale deed/ transfer deed: This is the most popular form of transfer of immovable assets. While this is the most straightforward method, sometimes it is not the most cost-effective form of transfer. Gift deed: Used in situations such as voluntarily transferring property to others without a request of transfer of money. The property is given as a gift, and it is a capital asset for the recipient(s). In the Indian context, this process is commonly seen when used to transfer property to women relatives such as sisters and daughters. There is no tax implication when transferring to some relations such as siblings, spouse, lineal descendants etc., which is another reason for people to prefer this method. Inheritance or execution of Will: Through this method, family members can be transferred property to, in proportion of the property owner’s choice. The property transfer occurs after the passing away of the original owner. Relinquishment Deed: In case of multiple owners, when one partner wants to sell to one other or more partners, they use this process, by which they sell their share to others invested in that property, for money.
