  5. Taxation • Capital Gains Tax: • 28% CGT rate for high earners from 23 June 2010 • Value Added Tax: • VAT to increase to 20% from 4 January 2011

Local Housing Allowance • LHA payments will be calculated differently: • From October 2011 • This will reduce LHA payments Individual LHA awards will be cut from April 2013: • By 10% • For claimants of Jobseekers Allowance • For 12 months or more Maximum LHA awards payable will be capped from April 2011

Planning Permission for Shared Houses Use Class C4: Houses in Multiple Occupation • Came into effect on 6 April 2010 • Planning Permission required for all residential property let to between 3 and 6 sharers Withdrawn: • From 1 October 2010 • Planning Permission no longer required for HMOs < 7 sharers Unless Council gains approval from the Secretary of State • Article 4 Permitted Development Rights • 12 months notice and full consultation

Proof Existing Shared House? • The onus will be on the landlord : Keep your evidenceeg: • Documentation tenants living at the address • • Tenancy agreements • Rent statements • Tenancy Deposit Protection Certificates• Copies of adverts • • Copies of Possession Notices• Copies of correspondence to your tenants • Certificate Of Lawful Development?

  9. Discretionary Licensing April 2010:Local Authorities no-longer need to apply to central government for permission to establish an additional or selective licensing scheme in their local area. Consultation :Still necessary, be alert. With Licensing comes Fees!

Assured Shorthold threshold increase Threshold to increase from £25,000 to £100,000 per year To come into effect from 01 October 2010 Applied retrospectively Complex: Only Court can rule; Seek further advice Tenancy deposits taken in relation to a tenancy set up on or after 1st April 2007 will need to be protected with an approved scheme AST possession proceedings, watch dates, Exemptions inc Regulated Tenancies and Renting a room in your own home

Deposit protection • High Court Ruling: Its never too late –Or Is It? • Scheme may Impose penalties • Landlords to pay Tenants legal costs • Not tested every scenario, e.g. if tenancy ended • Best practice: Remember it is the Tenants Money • Act in Spirit of Scheme and continue to protect Deposit
