Chapter 43D – What is it? • A law that provides communities with a tool for proactive development of sites appropriate for commercial, industrial or mixed-use development • Guarantees local permitting decisions on priority development sites within 180 days • Encourages targeted economic development • Not intended to alter the jurisdictional authority of permit issuing authorities

  3. Chapter 43D – Benefits • Access to a one-time technical assistance grant up to $60,000 • Priority consideration for state grant applications • National site promotion through the Mass. Association of Economic Development • Technical assistance from our Regional Planning Agency (MRPC) and/or Mass. Development

  4. Chapter 43D – Criteria • Town must identify a qualifying parcel(s) as a Priority Development Site (PDS) and obtain permission from owner • PDS site must be zoned for commercial, industrial or mixed-use development • PDS site must be able to accommodate a building of at least 50,000 SF of gross floor area • Town must vote to accept the program and the PDS site(s) at a Town Meeting • Town voted to accept the program and two PDS sites at Special Town Meeting in October 2008

  5. Chapter 43D – Process • Town must vote to opt in to the 43D Expedited Permitting program • Town must identify and approve the PDS site(s) • Within 120 days of approving the program and sites, the Town must establish a process for implementing the 180-day permitting timeframe

  6. Approved Priority Development Sites • Lancaster Technology Park Old Union Turnpike – 102 acres • Ascetic Hill Park Lunenburg Road – 179 acres

  7. AdditionalPriority Development Sites • Chisholm Property – off of Fort Pond Road • 3 parcels totaling 145 acres • Zoned as Limited Office, Highway Business and Mixed-Use

  8. AdditionalPriority Development Sites • Hill Property – off of Lunenburg Road • 1 parcel comprised of 25 acres • Zoned as Limited Office, Residential and Mixed-Use
