  2. Background ► Stakeholder interests have become more important for business. ► This can be seen as part of a more comprehensive development in Corporate Social Responsibility (CSR), where enterprises are expected to take responsibility for the prevention and resolution of social problems.

  3. Aims ► The aim of our study is to investigate how the development of Corporate Social Responsibility (CSR) has influenced clients’ responsibilities in the construction industry, both in relation to safety at work and in the strategic management of stakeholder interests.

  4. Approach ►Case Study Approach: Historical (institutional) study of construction projects and safety regulation. ►Data sources: Multi- local sampling methods (interviews and observations), and archival materials.

  5. Study design • Institutional analysis of safety governance in Denmark 1954 – 2005 (Identify regulative, normative and cultural-cognitive changes). • Case analysis of 4 large construction projects 1988-2005 (Identify Client responsibilities, safety management, management of institutional environment, performance data).

Soft Law – a definition • Rules of conduct that are laid down in instruments which are not legally binding, as such, but may produce substantial effects that the legal framework is aiming at. • Examples: • Audit and Certification (e.g. OHSAS 18001) • Performance indicators, e.g., used in the selection of bidders for public construction work. • “Smileys” indicating the willingness and ability to manage safety.

Conclusion 1/2 Stakeholder interest gave an impetus to the establishment of client responsibility at larger public construction projects, which had a positive impact on safety management on construction sites. New institutionalised forms of shareholder representation emerged, which could be an impetus for further use of soft law in health and safety regulation.

  12. Conclusion 2/2 A negative impact is that the JSHC seems to be left out and that management ventures into “incentive schemes” and compensatory “precautions” for short term results – in order to meet stakeholder demands. This is a challenge for the developers of soft law instruments.
