  2. Interrogation • Interrogation is the formal questioning of suspects while they are in custody • Strict rules govern interrogation

  3. Miranda v. Arizona • This landmark interrogation case established rules for interrogation of criminal suspects • It gave rise to “Miranda warnings”

  4. Miranda Warnings • You have the right to remain silent • Anything you say can and will be used against you in court • You have the right to an attorney • If you can’t afford an attorney, the state will appoint one for you at state’s expense

  5. Juveniles and Miranda • Initially Miranda applied only to adults • Miranda now applies to juveniles as well; however, juveniles receive no special consideration

  6. Challenges to Interrogations • Was suspect in custody? • Did suspect request presence of adult? • Did suspect waive Miranda rights? • Was waiver valid? • Did suspect invoke Miranda?
