Antitrust Caution • Participants on GS1 committees, task forces, work groups, task groups, or other similar bodies, must always remember the purpose of the committee, task force, or work group is to enhance the ability of all industry members to compete more efficiently and effectively to provide better value to the consumer or end user. Because GS1 activity almost always involves the cooperation of competitors, great care must be taken to assure compliance with anti-trust laws. This means: • Participation must be voluntary, and failure to participate shall not be used to penalize any company. • There shall be no discussion of prices, allocation of customers or products, boycotts, refusals to deal, or market share. • If any participant believes the group is drifting toward impermissible discussion, the topic shall be tabled until the opinion of counsel can be obtained. • Meetings shall be governed by an agenda prepared in advance, and recorded by minutes prepared promptly after the meeting. Agendas, where appropriate, and minutes are to be reviewed by counsel before they are circulated. • Tests or data collection shall be governed by protocols developed in consultation with and monitored by counsel. • The recommendations coming out of a GS1 committee, task force, work group or task group are just that. Individual companies remain free to make independent, competitive decisions. • Any standards developed must be voluntary standards.

The GS1 New Business System – Application Process • Prerequisite/ Requirements. • Prefix(es) can only be issued out to a member when CGCSA has received payment. • A member can only have 5 sets of 10 prefix ranges. If they need an additional range, they will have to apply for a 100 or above and they will pay the administration fee of the range and the pro rata amount of the annual fee. • A member can only have 20 sets of 1 prefix ranges. If they need an additional range, they will have to apply for a 100 or above and they will pay the administration fee of the range and the pro rata amount of the annual fee.

  29. The GS1 New Business System Turnaround time • All calls/incidents must be attended or responded to within 48 hours. • Member must receive their prefix within 48 working hours of receiving payment.

The GS1 Termination • Process whereby a member cancels the contract they have with CGCSA • Conditions for a Terminations • No Active products on the retail space • If the company has products on the retail space, Letter from the Retailer confirming the company has ceased supplying the products.

  33. The GS1 New Mergers and Acquisitions. • Process whereby a member prefix(es) are whole taken over or partially taken by either a member or non member of CGCSA. Conditions for Mergers and Acquisitions. • If the acquiring company is already a member of GS1, they must not be owing GS1. • If the acquiring company is not taking over liability of the company they are acquiring and the acquired owes GS1, the acquired company must pay the outstanding amount before the transfer can be done. • If the acquiring is taking over liability of the company they are acquiring and the acquired owes GS1, the acquiring company must pay the outstanding amount.

  34. The GS1 Reduction • Process whereby a member applies to have a barcode range that has few barcodes than the current range they own. Conditions for Reduction • Can only be done on prefixes that were applied before 2007 • The prefix range should be 1 000 and above. • A reduced prefix cannot be reduced. • All reduction that are not completed in three months will be billed on using the prefix ranges on PMS.
