  8. Issue of one time vacancies During 1991 in view of this large scale stagnation in the cadre of group 'B' officers, the Railway Board in consultation with UPSC decided to allot additional posts for induction to Group 'A' for 5 Deptts as under:-

  9. Issue of one time vacancies The additional vacancies traffic & personal were filled up and additional vacancies of civil Engg dept were partially filled (158 out of 238) during the early 1990s. Before it could be implemented fully it was challenged on various tribunals that govt is not entitled to increase the quota for promtee officers However this was challanged by S&T dept which won a supreme court case for the additional vacancies, but as the court case had dragged on for years ended up with more damage. While giving the ruling in favour of officers of S&T department, Supreme court had observed that govt is empowered to vary the %age of intake and that S&T department cannot be treated differently from traffic & stores department. On the basis of supreme court judgment, the same benefit extended to S&T department needs to be extended to Engg dept for the balance 80 vacancies and 52 vacancies of electrical department.
