  2. RECOMMENDED ACTION: Authorize a letter to VDOT and CTB sharing information about the possible effect of FHWA rescissions on CMAQ and RSTP funds for Northern Virginia transit and asking that choices of how much CMAQ and RSTP to return to FHWA be made fairly and openly. 2

  3. BACKGROUND: • The Surface Transportation Policy Project has provided nationwide information showing that CMAQ and other federal transportation funds have not been spent in proportion to their allocations. When FHWA requires some funds to be returned, these available CMAQ allocations provide a tempting target. 3

  4. Data for Virginia show that $31.2 million must be returned this year. CMAQ comprised 5.1% of apportionments but only 2.8% of obligated balances, resulting in 3.8% of funds available to be returned. 4

  5. RSTP, another category used by transit, was 7.9% of apportionments but only 3.2% of obligations, leaving 21.1% of the funds available to be returned. • Rescissions are expected to continue at this level for several years. 5
