    • Case: Christopher McKay, 19, arrested for impaired driving. Placed one phone call and gave up.
  • Ruling: McKay was not given reasonable opportunity to access a lawyer.
    • “We are at an unprecedented time in human history…the vast majority of individuals born after the year 1980 first look to the virtual world for information.”

WHAT NEXT?

  • Access to internet is part of a detainee’s reasonable opportunity to contact legal counsel
  • Every police station should have computers and internet at the ready for such situations.
