  3. Custody Evaluation • Items 1-7 comprise the custody score • Severity of Conviction on Current Incarceration-this is the most serious, including all CC,CS, active SS, rebill cases, detainers and warrants.

  4. SCORING • LOW-O POINTS • MODERATE-1 POINT • HiGH/HIGHEST- 4 POINTS

  5. ESCAPE HISTORY SCORING • Enter 0 points if there is no history of escapes or attempts • Enter 0 points if the inmate/offender has escaped from community corrections, halfway house or community supervision(PPCS, GPS or EMP) • Enter 6 points if the inmate has two or more escapes or attempted escapes from minimum security, TDU, or juvenile detention within the past ten years • Enter 7 points if the inmate has escaped or attempted escape from minimum security, TDU, or juvenile detention within the past 5 years

  6. ESCAPE HISTORY SCORING CONTINUED 5. Enter 10 points if the inmate has ever escaped or attempted escape from medium or maximum security, county jails, juvenile institutions, restricted/ segregated housing unit or an escape from any level of security that resulted in an injury to another or a felony conviction for a violent crime while on escape status, unless the inmate receives zero points for age (age 41 or over). FOR EXAMPLE: If an inmate receives points in this section and She is under the age of 41, they would remain in effect until such a time she receives zero points for age. If she is received into custody and is over the age of 41 and has an escape/attempted escape that falls within these guidelines, no escape points will be assessed.

  7. NUMBER OF ACTIVE DISCIPLINARY CONVICTIONS All Class B convictions within the last 6 months; Class A convictions within the last year and all Class X (excluding escapes) within the past 2 years. • Enter 0 points if the inmate has received no disciplinary convictions • Enter 1 points if the inmate has one disciplinary conviction or • Enter 2 points of the inmate has 2 disciplinary convictions or • Enter 3 points if the inmate has 3 or more disciplinary convictions

  8. MOST SERIOUS DISCIPLINARY CONVICTION • MOST SERIOUS DISCIPLINARY CONVICTION FROM THE DATE OF THE ASSESSMENT. ALL CLASS B CONVICTIONS WITHIN THE LAST 6 MONTHS, ALL CLASS A CONVICTIONS WITHIN THE PAST YEAR, NON-PREDATORY CLASS X WITHIN THE PAST YEAR AND PREDATORY CLASS X (X2-THROUGH X10) WITHIN THE PAST 2 YEARS.

MOST SERIOUS DISCIPLINARY CONVICTION CONTINUED • Enter 0 points if the inmate has no disciplinary convictions • Enter 0 points if the most serious disciplinary conviction is a Class B • Enter 2 points if the most serious disciplinary conviction is a Class A or • Enter 3 points if the most serious disciplinary conviction is a non predatory Class X or • Enter 4 points if the most serious is a predatory Class X (X-2 through X-10)

  10. ESCAPES • ESCAPES ARE SCORED IN THE ESCAPE SECTION OF THE INSTRUMENT WITH THE FOLLOWING EXCEPTIONS:

ESCAPES CONTINUED • Escapes will be addressed in the escape section, with the following exceptions: Escape from community corrections, halfway house PPCS, GPS, EMP will be assessed misconduct points if within the applicable time frames.If an inmate has any escape or attempted escape from maximum or medium, county jail juvenile institution, restricted/segregated housing unit or escape from any level of security that resulted in an injury to another or a felony conviction for a violent crime while on escape status and is not assessed points in the escape history of the custody assessment due to his age, will be assessed misconduct points if within applicable time frames

  12. PROGRAM PARTICIPATION • POINTS IN THIS SECTION ARE BASED UPON THE INMATE’S PARTICIPATION IN AN ASSESSED AND APPROVED EDUCATION, COGNITIVE BEHAVIORAL, LIFE SKILLS (CIMC/ PRINCIPLE LIFE SKILLS ONLY), CAREER TECH OR SUBSTANCE ABUSE PROGRAM. • 0 points if the inmate has no program needs, has participated in, is on a waiting list for, or actively participating in AN APPROVED EDUCATION, COGNITIVE BEHAVIORAL, LIFE SKILLS (CIMC/PRINCIPLE LIFE SKILLS ONLY),CAREER TECH OR SUBSTANCE ABUSE PROGRAM or HAS REFUSED OR FAILED AN APPROVED EDUCATION, CAREER TECH OR SUBSTANCE ABUSE PROGRAM • ENTER -1 if the inmate has completed AN APPROVED EDUCATION, COGNITIVE BEHAVIORAL, LIFE SKILLS (CIMC/PRINCIPLE LIFE SKILLS ONLY), CAREER TECH OR SUBSTANCE ABUSE PROGRAM DURING THIS INCARCERATION

  13. PLEASE NOTE!!! • SEE OP-090101 ATTACHMENT C for a list of approved programs The -1 is for the entire incarceration! MUST be AN ASSESSED AND APPROVED EDUCATION, COGNITIVE BEHAVIORAL, LIFE SKILLS (CIMC/PRINCIPLE LIFE SKILLS ONLY), CAREER TECH OR SUBSTANCE ABUSE PROGRAM!

  14. ADJUSTMENT EARNED CREDIT LEVEL • Enter 1 point if the inmate is currently assigned to level I • Enter 0 points if the inmate is currently assigned to level II • Enter -1 point if the inmate is currently assigned to level III or IV

  15. CURRENT AGE • 3 points if the inmate is 20 or younger • 2 points if the inmate is 21-31 • 1 point if the inmate is 32-40 • 0 points if the inmate is 41 or over

  16. SCALE SUMMARY AND RECOMMENDATIONS • TOTAL SCORE ON ITEMS 1-7 MINIMUM-10 OR FEWER POINTS ON ITEMS 1-7 MEDIUM-11 OR MORE POINTS ON ITEMS 1-7

  17. RE-ENTRY • All medium assigned inmates regardless of assessed custody level meeting the following criteria will have a minimum packet submitted to the Population Office. • a. Has a total of 2,920 days or less remaining. • b. Has no felony detainers. • c. Has no active class X misconduct(s).

  18. RE-ENTRY CONTINUED • Is assigned to earned credit level 3 or 4 or enhanced level 3 or 4. • e. Has no current sex inmate registry crime(s). • f. Has no current sentence for any “Crimes Against Children” listed in OP- 060104, Attachment A. • g. No active escape points.

MANDATORY OVERRIDES • TIME LEFT TO SERVE-HIGHEST CRIME CATEGORY-ANY convictions in the highest crime category-total time left to serve is greater than or equal to 5475-no lower than medium • SENTENCE of LIFE/LIFE WITHOUT or a total sentence of 100 YEARS OR MORE-no lower than medium • ICE DETAINER-ANY convictions in current incarceration in high or highest crime category-no lower than medium • RESTRICTED EARNED CREDITS (85 Percent and Trafficking)-inmate has restricted earned credits (i.e. trafficking or must serve 85 percent of sentence prior to receiving earned credits) and total time is greater than or equal to 3600 days-no lower than medium security

MANDATORY OVERRIDES CONTINUED • Inmates with non-violent crimes who have a total sentence length of Life, with a determinate amount of time to serve (i.e. Endeavoring to Manufacture CDS, Life with all but the first 20 years suspended) and the time left to serve is greater than or equal to 3600 days-no lower than Medium

  22. MANDATORY OVERRIDES CONTINUED • Restricted Earned Credits (50 percent) • Distribution of CDS within 2000 feet of a school, park, etc.; Possession/Purchase of CDS within 1000 feet of a school, park, etc.; Possession/Purchase in the Presence of a Child under 12; or any other conviction where 50 percent of the sentence must be served prior to earning credit and total time left to serve is equal to or greater than 5475-no lower than medium

  23. MANDATORY OVERRIDES CONTINUED • Escape Points-any inmate with escape points greater than 6-no lower than Medium

  24. DISCRETIONARY OVERRIDES-HIGHER • CIRCUMSTANCES OF THE OFFENSE • HISTORY OF VIOLENCE • TIME LEFT TO SERVE • FELONY DETAINER/PENDING CASES

DISCRETIONARY OVERRIDES-HIGHER CONTINUED • OTHER: • Any other attributes associated with the inmate that justify an override to a higher custody level such as self-reported criminal history information, crimes older than ten years, an extensive number of prior convictions or escape threats/history Complete documentation of this factor must be contained in the inmate’s file or other ODOC records. • Documentation • Justification for use of an override will be documented in the comment section.

  26. DISCRETIONARY OVERRIDES-LOWER • CIRCUMSTANCES OF THE OFFENSE • TIME LEFT TO SERVE-If an inmate has a short amount of time left to serve on a high, moderate, or low category crime, it may be appropriate to transfer the inmate to a lower custody assignment. • PROGRAM COMPLETION-If the inmate has successfully completed all recommended programs, it may be appropriate to transfer the inmate to a lower security assignment. • OTHER • DOCUMENTATION-Please justify the override in narrative form in the comments section of the CAS and FAF

  27. RECOMMENDED CUSTODY LEVEL • After reviewing the scale score and all information, mark the recommended custody level • MEDIUM • MINIMUM • If applicable, indicate placement at community corrections or GPS

CUSTODY LEVEL CONTINUED • INMATES WITH 10 OR FEWER POINTS ON ITEMS 1-7 NORMALLY WILL HAVE 9000 DAYS REMAINING OR LESS TO BE MINIMUM ELIGIBLE • COMMUNITY PLACEMENT 4000 DAYS OR LESS REMAINING AND MEET CRITERIA PER 060104 • GPS PLACEMENT-5 YEARS OR LESS OR HAVE 11 MONTHS OR LESS REMAINING AND MEET CRITERIA PER 0601001

  29. THE REST… ONCE THE ASSESSMENT IS COMPLETED AND THE CUSTODY LEVEL DETERMINED, THE INSTRUMENT MUST BE SIGNED AND DATED BY THE CASE MANAGER, COMMITTEE MEMBERS AND THE INMATE. ROUTINE ASSESSMENTS REQUIRE THE APPROVAL OF THE CMIV. FACILITY HEAD APPROVAL IS REQUIRED IF THERE IS ANY NON-ROUTINE ACTION SUCH AS A DISCRETIONARY OVERRIDE. MANDATORY OVERRIDES DO NOT REQUIRE SUCH APPROVAL. THE INMATE’S SIGNATURE IS REQUIRED IF THE FACILITY HEAD CHANGES THE RECOMMENDED ACTION IF APPLICABLE, TRANSFER PACKET TO THE POPULATION OFFICE
