Hiring an Appellate Attorney? Read This First!

Do you know what an appeal is? It is a request for a higher court to review the decision of lower courts. The appeals court reviews the records there in the trial court, but nothing new can be added to them. It is less appealing and is usually handled by the federal appeals attorneys who are experienced and skilled at research and have handled similar cases in the past. http://bit.ly/38VcLE2

The appeals court decides whether to affirm the decision of the trial court or reverse it based on the written submissions.

  2. The appellate lawyer represents you as an appellant, the appealing person. He tells the court why the trial court made errors, and the decision should be reversed. When you are meeting with an appeals lawyer, they will ask you for some papers. Judgement is the first thing that they will ask for. The appeals lawyer will want to find out whether it is final, signed, and appealable or not. Then the appeals lawyer will ask for the records of the case: He will look at the transcript of the hearing. A document which the court has viewed. They are needed to decide whether there is an appealable issue. Whether the trial judge made a mistake that can be corrected by the appeal? The appellant will try to tell the appeals lawyer about the various mistakes that their lawyer had made. It is not of much help as the appeals lawyer will have to work with the things in the record. You need to bear this in mind that the appellate court will not review anything which is not presented or is not a part of the official record from the trial court.
