  4. Purpose • Award of annual term contract for “Transport, Processing and Disposal of Biosolids from the Eastern and Northwestern Water Reclamation Facilities”

Background • Biosolids • Primarily organic solid product produced by wastewater treatment processes that can be beneficially recycled and meets US Federal criteria for beneficial reuse • Orange County’s 3 regional facilities produce a total of approximately 100,000 tons of biosolids per year or 262 tons per day

Background –Timeline • 12/1/06 - Shelley’s begin operations under most recent annual term contract • 10/14/10 – DEP issued “Notice of Permit Denial” • 11/30/10 – Shelley’s contract expired and was not renewed • 12/1/10 – N-Viro began providing biosolids services under emergency contract • 12/22/10 – IFB issued for new annual contract • 12/30/10 – Shelley’s agreed to a “Consent Final Judgment” with the FDEP and received a new 5-year permit • 1/11/11 – BCC ratified emergency contract to N-Viro

  9. Current Issue • On 1/13/11 IFB Y11-178 was opened: • Shelley’s Environmental Systems $1,826,000 • T. Wayne Hill Trucking $2,319,875 • Sweetwater Environmental $2,491,352 • Merrell Brothers $2,497,760 • Showcase of Citrus, Inc. $2,548,742 • C & W Global $2,585,675 • Florida N-Viro $2,626,000 • Karle $2,886,040

  10. Current Issue • Shelley’s is the low bid by $494,000 annually • DEP has agreed to issue Shelley’s a new 5-year permit • Conditions of the new permit: • 3rd party oversight • Quarterly reporting • Transfer of operations to new operator

  11. Current Issue • County will increase monitoring to verify contract, regulatory, and National Biosolids Partnership compliance • Monthly FDEP inquiries • Increased field inspections

Requested Action • Approval to award Invitation for Bids Y11-178-PD Transport, Processing and Disposal of Biosolids from the Eastern and Northwest Water Reclamation Facilities Term Contract to the low responsive bidder, Shelley’s Environmental Systems in the estimated award amount of $1,826,000
