Pension Lawsuit ReportTimeline • Jan 1997 – New plan established • In 1998 MTS began a five and half year contribution holiday, exhausting the initial 100% employee generated $43M surplus • Nov 2008 – Thirteen-week trial concludes • Jan 2010 – MTS to pay $100M to plan members • Apr 2010 – MTS filed a Notice of Appeal • Dec 2010 – Appeal hearing (Dec 13th to 15th) • Nov 2011 – Awaiting Appeal Court decision

NegotiationsRecent Settlements and TEAM • TEAM ratified the Agreement Sep 9, 2010 0% increase in 1st year 0% increase in 2nd year 2% increase in 3rd year + max VPP payout up by 1% + $500 lump sum Only the 2% increase in salary is pensionable First four hours in a week at 1.5x, remainder at 2x

NegotiationsRecent Settlements and TEAM • CEP and IBEW ratified their agreements: 1% increase, retro: Dec 19 for CEP, Feb 1 for IBEW 1% increase in 2nd year 2% increase in 3rd year 2% increase in 4th year (IBEW only) All increases are to base salary and are pensionable Overtime remains at 2x for all hours worked No change to VPP, no lump sum payment
