  3. §52: Justice Reinvestment Account • The Justice Reinvestment Account is established, separate and distinct from the General Fund. • All moneys in the account are continuously appropriated to the Oregon Criminal Justice Commission for the purpose of making grants to counties in accordance with section 53 of this Act.

  4. §53: Grant Review Committee • 1(a): In consultation with the Justice Reinvestment Grant Review Committee…the Oregon CJC shall administer the Justice Reinvestment Program[]. • The CJC shall award grants to counties that establish a process to: • assess offenders and • provide a continuum of community based • sanctions, • services and • programs • that are designed to reduce recidivismand decrease the county’s utilization of imprisonmentin DOC while protecting public safetyand holding offenders accountable.

  5. §53: Grant Review Committee • 1(b): …No less than 10% of grant funds awarded under this section must be distributed to community-based nonprofit organizations that provide services to victims of crime.

  6. §53: Grant Review Committee • 3(a): A majority of the voting members of the committee constitutes a quorum for the transaction of business. (need 3) • 5 voting members: • DA • Sheriff • Chief of Police • County Commissioner • Community Corrections • 4 non-voting members: • 2 Senators • 2 Representatives

  7. §53: Grant Review Committee • 3(b): The committee shall elect one of its members to serve as chairperson. • 3(c): If there is a vacancy for any reason the appointing authority (Governor) shall make an appointment effective immediately. • 3(d): The committee shall meet at times and places specified by the call of the chairperson or a majority of the voting members of the committee. • 3(e): Legislative members of the committee shall be entitled to payment of compensation and expenses under ORS 171.072, payable from funds appropriated to the Legislative Assembly.

  8. §53: Grant Review Committee • 4: An application for a grant must be submitted by a local public safety coordinating council convened under ORS 423.560. • 5(a): During a grant application period established by the CJC, the proportion of grant funds available to each county shall be determined in accordance with the formula used to distribute baseline funding under ORS 423. 483. • 5(b): …If unallocated funds remain at the conclusion of the grant acceptance period, the CJC may establish a supplemental grant period and distribute the unallocated funds.

  9. §53: Grant Review Committee • 6: The CJC shall regularly evaluate the community based sanctions, services and programs funded under this section. The CJC shall report to the judiciary committees. • 7(a) & (b) relates to reentry courts.

  10. §53: Grant Review Committee • 8. After consulting with the Justice Reinvestment Grant Review Committee, the CJC shall adopt rules to administer the Justice Reinvestment Program. The rules must include: • (a) A methodology for reviewing and approving grant applications and distributing grant funds • Rules described in this paragraph must provide the Grant Review Committee with the ability to approve grant applications, subject to final approval by the CJC.

  11. §53: Grant Review Committee • 8(b): a process for evaluating the efficacy of community based sanctions, services and programs funded under this section. • Of Note: • §41(2) “cost effective” means that a benefits realized over a reasonable period of time are greater than costs, as determined utilizing a cost-benefit analytical tool identified by CJC. • §41(5) “Scientifically based research” means: • (a) employing systematic, empirical methods that draw on observation and experiment. • (b) involving rigorous data analyses that are adequate to test the stated hypotheses… • (c) relying on measurements or observational methods that provide reliable and valid data …across evaluators, observers, studies… • (d) utilizing randomized controlled trials when possible and appropriate.

  12. §53: Grant Review Committee • 9(a): “community based programs” includes: • (A) Work release programs; • (B) structured, transitional leave programs; • (C) Evidenced-based programs designed to reduce recidivism that include the balanced administration of sanctions, supervision and treatment; • (D) Reentry courts • (E) Specialty courts aimed at medium and high risk offenders

  13. 2013 JRI Distribution • §53(5): Notwithstanding (1)-(4) of this section: • (1) Upon receipt of a letter of intent to participate in JRI submitted by a county • (2) The CJC shall distribute a proportional share of funds deposited in the account • (3) The proportion is determined by the baseline funding formula • To date, the CJC has received 20 letters of intent to participate. • 2 counties have already received their JRI funds (Marion and Multnomah)

  15. RIC meetings • The RIC is a feedback loop that will allow counties to evaluate the programs that they are putting into place with peer feedback and DOC data. • The CJC will deliver Prison bed usage data on monthly basis broken down by region and by county • Each participating county will send 1 or more members from their LPSCC. • Participating members will discuss what is happening in their counties and what is working.
