4. Legal Implications Duty of Care Negligence Duty of Care: Those in charge of sports premises have the capacity to make those premises safe. Or unsafe and are therefore responsible if injury occurs to persons such as sports participants, players or spectators Foreseeability Test: In a case of a water skier who was injured after colliding with a stationary boat. The skier sued the driver of the boat arguing that the driver’s failure to warn the skier of the danger (stationary boat) was negligent. It was foreseeable that the skier would be injured from the driver’s failure to warn hance the driver was negligent.
