Reimbursement of unemployment benefit (Reg. 883/2004 art. 65(6), 65(7) • Many Estonians work in Finland, while residing in Estonia • High number of benefit applications in EUIF • Aggregation of periods • Estonia pays the benefit (state of residence) • Reimbursement claims sent to KELA • state of work (Finland) reimburses the benefit

  3. Reimbursement of unemployment benefit (Reg. 883/2004 art 65(6), 65(7) • From January to June 2012 we have had already 524 benefit applicants, who previously worked in Finland • From June 2011 until August 2012 KELA has reimbursed over EUR 300 000

Granting unemployment benefit – question of residence • Case regarding art 11, Reg 987/2009 and art. 65 p. 2 Reg 883/2004 – Estonia as state of residence Typical unemployment benefit applicant - • Estonian citizen worked in Finland for a couple of years, while his family resided in Estonia. During his working period in Finland, he regularly visited his family in Estonia (for example one time per month, so not to be considered as frontier worker according to Reg. 883/2004). He worked under temporary contract and the purpose of working in Finland was to earn a living for his family. • Estonia consider him as Estonian resident • Also resident in Finland (according to Finnish law)?

Aggregation of periods • High number of benefit applications in EUIF • EUIF sends SED-s U001 to KELA • In order to issue SED U002-s, KELA needs certain information from person`s Finnish employer. When employer does not correspond to KELA-s request, no insurance periods may not be confirmed -No aggregation of periods -EUIF cannot pay unemployment benefit

Fraud and error • Valid employment contract in Finland, while applying unemployment benefit in Estonia (temporarily laid off from work, lomautettu) • Usually person`s do no know/understand the meaning of this and they consider the employment as ended) • Before granting unemployment benefit, these cases are being investigated (additional information from the employer/KELA) • Registration as an unemployed is terminated and no unemployment benefit is paid
