Annexation • Purpose • To provide urbanizing areas with municipal services and to exercise regulatory authority necessary to protect public health and safety. • Means of ensuring that residents and business outside a city’s corporate limits who benefit from access to the city’s facilities and services share the tax burden associated with constructing and maintaining those facilities and services. • To secure tax base or utility revenue sources. • Imposition of land use controls may also be used as a growth management technique to implement a comprehensive plan.

Annexation Requirements • Cities may only consider annexing property in their ETJ • Area must be contiguous to the City’s corporate limits • Cities may annex up to 10% of their total area per year – allowable area may be accrued for up to three years • Width of area must be a minimum of 1,000’ • Cities must have an annexation plan - areas identified for annexation must be included in the plan (with exceptions)

Existing Annexation Plan • Adopted in December 1999 • “No areas identified for annexation” • May annex exempt areas, process petitions without amending plan • Exempt area – an area with fewer than 100 separate tracts of land on which one or more residential dwellings are located on each tract.

  10. Annexation Area Summary Exempt • Allowable annexation area: 9,081 acres • Proposed area: 6,730 acres or 74% of allowable area 3-year plan • Allowable annexation area: 11,104 acres

  11. Next Steps • Exempt annexation areas identified by surveyor • Council adopts ordinance authorizing preparation of service plan • Staff develops service plan • Council conducts two public hearings before final adoption of annexation ordinance

  12. City Service Obligations Immediate Services • Police Protection (includes animal control) • Fire Protection / EMS • Solid Waste Collection • Maintenance of Public ROW • Zoning • Building Inspections • Community Enhancement

  13. Other Services • Wastewater (addressed in service plan) • Water (served by Wellborn SUD) • Electricity (served by BTU) When applicable, services must be provided within 2 ½ years (4 ½ years when the City provides a schedule).
