  3. Employee use of cell telephones with the capability of taking pictures, making videos, and taping conversations:

  4. To ensure resident privacy and dignity, a facility must have a Policy and Procedure regarding possession and use of cellular telephones while caring for residents residing in the nursing home.

  5. IJ (Immediate Jeopardy) LEVEL TAGS S/S “J”, “K”, “L”

  6. Surveyors do not have to remain on site until the IJ situation is removed.

  7. Once the Administrator is notified of the IJ situation, the facility is responsible for the care and safety of the residents in immediate jeopardy.

  8. When surveyors determine there is an IJ situation, the IJ is either removed before exit or the IJ remains in place at exit.

  9. When an IJ situation remains in place at the time of exit:

  10. A facility must remove the IJ situation, S/S “J”, “K”, “L”, or their provider agreements are terminated in 23 days.

  11. The Facility must submit to the field office a plan of removal. This is the plan the facility puts into place to remove the IJ.

  12. Surveyors will conduct a revisit to determine if the IJ is removed.

  13. When the IJ is removed, the termination date is extended. (up to 6 months from the start of the term track).

  14. When an IJ is removed before exit:

  15. The scope and severity documented on the 2567L (statement of deficiencies) will be a “J”, “K”, or “L”. • The scope and severity the deficient practice continues at will be documented in the deficient practice statement.

  16. The next topic deals with continued confusion regarding a facility being in “a correction mode”.

  17. A period of correction when a “facility was in a correction mode” ended in 1999. Before 1999, surveyors could not write new deficiencies on surveys conducted after an existing survey and before the latest completion date of that existing survey. CMS ended this practice in 1999.

  18. After a survey occurs with a scope and severity of “D” or higher, surveyors can conduct a new survey and, if deficiencies are discovered on the new survey, write these new deficiencies.

  19. Involuntary discharge

  20. The facility must permit each resident to remain in the facility, and not transfer or discharge the resident from the facility unless: 1. the transfer or discharge is necessary for the resident's welfare and the resident's needs cannot be met in the facility; 2. The transfer or discharge is appropriate because the resident's health has improved sufficiently so the resident no longer needs the services provided by the facility; 3. The safety of individuals in the facility is endangered;

  21. 4. The health of individuals in the facility would otherwise be endangered; 5. The resident has failed, after reasonable and appropriate notice, to pay for (or to have paid under Medicare or Medicaid) a stay at the facility. For a resident who becomes eligible for Medicaid after admission to a nursing facility, the nursing facility may charge a resident only allowable charges under Medicaid; or 6. The facility ceases to operate.

  22. Before a facility transfers or discharges a resident, the facility must notify the resident and, if known, a family member or legal representative of the resident of the transfer or discharge and the reasons for the move in writing and in a language and manner they understand and record the reasons in the resident's clinical record.

  23. The notice must be a 30 day notice before the resident is transferred or discharged when : 1. The transfer or discharge is necessary for the resident’s welfare and the resident’s needs cannot be met in the facility; 2. the resident has failed to pay;

  24. Notice may be made as soon as practicable (less than 30 days) before transfer or discharge when: 1. the safety of individuals in the facility is endangered, 2. the health of individuals in the facility is endangered; 3. the resident’s health improves sufficiently so that the resident no longer needs the services provided by the facility; 4. an immediate transfer or discharge is required by the resident's urgent medical needs; or 5. a resident has not resided in the facility for 30 days.

  25. The written notice must include; 1. the reason for transfer or discharge; 2. the location to which the resident is transferred or discharged; 3 . the name, address and telephone number of the State long term care ombudsman; 4. for nursing facility residents with developmental disabilities, the mailing address and telephone number of the agency responsible for the protection and advocacy of developmentally disabled individuals;

  26. 5. for nursing facility residents who are mentally ill, the mailing address and telephone number of the agency responsible for the protection and advocacy of mentally ill individuals established under the Protection and Advocacy for Mentally Ill Individuals Act. 6. the effective date of transfer or discharge; AND

  27. 7. a statement that the resident has the right to appeal the action to the Division of Administrative Law and the DALs telephone number and address. DAL PO Box 4189 Baton Rouge, LA 70821-4189 225-342-0443

  29. Notice of bed hold:

  30. Before a nursing facility transfers a resident to a hospital or allows a resident to go on therapeutic leave, the nursing facility must provide written information to the resident and a family member or legal representative that specifies the duration of the bed-hold policy under the State plan during which the resident is permitted to return and resume residence in the nursing facility. • At the time of transfer of a resident for hospitalization or therapeutic leave, a nursing facility must provide to the resident and a family member or legal representative written notice which specifies the duration of the bed-hold policy.

  31. A nursing facility must establish and follow a written policy under which a resident whose hospitalization or therapeutic leave exceeds the bed-hold period under the State plan, is readmitted to the facility immediately upon the first availability of a bed in a semi-private room if the resident requires the services provided by the facility; and is eligible for Medicaid nursing facility services.
