Policy 2445.41Instructional Resources Adoption: Notice, Request, and Instructions to Publishers • Instructional Resources replaced textbooks • Definition includes resources that are print, electronic, kit-based, etc. • Incorporated 3 other policies into this one: • Policy 2445.4 – addresses adoption of soft-bound resources • Policy 2445.43 – addresses inter-ethnic content • Policy 2445.412 – addresses appeal process

Additional Policy Revisions • Lexile & Quantile Measures must be provided within 90 days from notification of approval. • Bidding process clarified. • WVBE reserves the right to limit and/or remove category of loaned and/or free items. • May provide examination sample of hands-on and/or inquiry based learning materials; however, one complete set of materials for each investigation must be included.

  7. Additional Policy Revisions • Send Form B Warranty within 60 days of notification of approval. (Print Materials) • Send electronic copy of correlations to the Coordinator of Instructional Resources. §126-36-15. Severability. • 15.1. If any provision of this rule or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this rule.

Reminder: Blackout Window • refrain from contacting … anyone who may have influence over the adoption … to discuss items that may be on the bid. • This blackout period begins the date the Call is issued and ends the day after the WVBE approves the Official Multiple List. • Failure to comply with policy or the West Virginia Ethics Act may result in disqualification from the current adoption year and subsequent removal of any/all products from the Official State Multiple List.

  9. §126-36-5. Guidelines. 5.12. … Any vendor whose programs/materials are being initially considered through the waiver process, have not gone through the adoption process, and are not on the multiple list will have to follow the same bid guidelines and policies as required by those who went through the regular adoption process. All costs associated with a review and adoption of materials submitted through the waiver process will be at the vendors’ expense.
