  4. Comprehensive Plan and Land Development Regulations Overview: An amendment schedule for the LDRs was approved by the BCC in November, 2011. The first year includes amendments to the Agricultural Uses in Industrial, Special Event Signs, Zoning Board, and the Landscape Ordinance

Comp Plan Amendments In Process • Comp Plan Amendments (11 Amendments) • Pine Lakes Rural Support Corridor Amendment (Community store) • Vestings to 2030 Comprehensive Plan • Sector Plan Preparation • Wetland setback policy amendment for canals and previously granted average setbacks and variances

  13. LandscapeOrdinance • Changes have been drafted to improve and clarify the regulations. • Input has been received from interested stakeholders.

LandscapeOrdinanceProposed Changes General Changes • Provide an administrative waiver of up to 25% under certain criteria. • Clarify process for Agricultural Exemption for property seeking agricultural uses. • Delete irrigation requirements that are duplicated in other regulatory requirements • Increase area that may be cleared around structure from 5 feet to 15 feet.

  15. LandscapeOrdinanceProposed Changes Plant requirements • Change size of shrubs to a minimum container size • Clarify that shrubs can be clustered • Clarify that walls may be located within the buffer

LandscapeOrdinanceProposed Changes Landscape Buffer Requirements: • Restore 10 foot Type A buffer as option • Reduce number of Canopy and Ornamental Trees in each buffer by one. • Make groundcovers optional • Allow a wall as an option in Type A buffer between residential uses • Review requirement for buffer between CFD and A zoning • Provide new buffer limited to trees only

  17. LandscapeOrdinanceProposed Changes Landscape Buffer Requirements: • Clarify requirement for perimeter landscaping around non-residential buildings and provide example • Clarify that a landscape plan is not required for Single Family and Duplex lots

  18. LandscapeOrdinanceProposed Changes Landscape Buffer Table: • Restructure table to reduce buffer requirement for less intense uses developing adjacent to higher intensity uses.

LandscapeOrdinanceProposed Changes Tree Protection • Clarify that a Heritage Trees may be removed for safety reasons • Clarify exemption for Agricultural Uses • Clarify that no mitigation is required for trees removed due to disease or hazard • Eliminate Donation in Lieu of Mitigation and replace with Funds in Lieu system. • Combine Historic and Heritage Trees as one designation

  20. Effect on Existing Development • PUD, CP, CFD, MP Zoning and CUP Ordinances containing specific landscape requirements would be unaffected by proposed amendment.

  21. Next Steps • Approval to Advertise the Landscape Ordinance Amendments • Consideration of the Landscape amendments by the Zoning Board and BCC in March/April
