Uzorak istraživanja i prikupljanje podatakaThe sample of research and data collection • Istraživanje je zasnovano na podacima koji su dobijeni od 88 naručilaca sa raznih nivoa vlasti i različite strukture • Zahtevi za pristup informacijama upućeni takođe i na adrese 19 naručilaca koji uopšte nisu dostavili odgovora i 21 naručilaca koji su dostavili delimične podatke • Podaci prikupljani od Uprave za javne nabavke i većine privrednih i prekršajnih sudova; nije dobijen odgovor od Republičke komisije za zaštitu prava • Results based on data obtained from 88 purchasing entities from different government levels and with different structure • Requests for access to information of public importance submitted also to 19 purchasing entities providing no answer at all and 21 entities providing only partial data • Data collected from Public procurement office and majority of Commercial and Misdemeanor courts; no answer from Republican commission for protection of rights

Ekonomičnost i efikasnost • Ekonomičnost i efikasnost u procesu planiranja javnih nabavki su obezbeđeni samo na osnovnom nivou, time što naručioci u velikoj većini slučajeva donose obavezne planove javnih nabavki. Međutim, nedostaju sveobuhvatni kriterijumi na osnovu kojih se takvo planiranje vrši. Sistem javnih nabavki je fragmentiran i nema višegodišnjeg planiranja. • Kod sprovođenja javnih nabavki načela ekonomičnosti i efikasnosti su delimično obezbeđena kroz osrednje uštede u odnosu na planirane izdatke i kroz raširenu praksu traženja sredstava finansijskog obezbeđenja. S druge strane, šanse da se ekonomičnost i efikasnost unaprede kroz korišćenje elektronskih nabavki se još uvek ne koriste. • U fazi izvršenja ugovora ekonomičnost i efikasnost narušavaju značajna kašnjenja u plaćanju od strane naručilaca. Osim toga, čitav sistem je ugrožen značajnim kašnjenjem u sprovođenju obuke i izdavanju sertifikata službenicima za javne nabavke

Skorza Ekonomičnost i efikasnost • Nabavke se sprovode sa ciljem da osiguraju ekonomično i efikasno korišćenje javnih fondova- 5.4 • Naručioci racionalno troše javna sredstva kroz procedure javnih nabavki– 6 • Široka upotreba interneta kako bi se povećala efikasnost procedura javnih nabavki i ssmanjili troškovi naručilaca - 0 • Naručioci su poštovali rokove u javnim nabavkama– 10 • Tenderska dokumentacija i kriterijumi za evaluaciju su u vezi sa obimom i predmetom nabavke – 4.6 • Finansijsko upravljanje naručioca vezano za javne nabavke funkcioniše odgovarajuće - 2,1 • Dobavljači poštuju ugovorne obaveze - 8 • Naručioci imaju kvalifikovane službenike za javne nabavke – 0 • Literatura o javnim nabavkama je dostupna - 7

  7. Economy and efficiency • Economy and efficiency in planning phase of public procurement is ensured only on basic level, by preparation of mandatory annual public procurement plans, but without comprehensive criteria to base planning on, with large fragmentation of public procurement system and lack of multy-annual planning. • In middle phase of the process, economy and efficiency is moderately ensured through modest savings made in comparison with initial estimations and widespread practice to ask for financial guarantees. On the other hand, the chance to improve economy and efficiency by using of e-procurements is still not used. • In execution phase, the economy and efficiency is endangered by significant delays in payments. Furthermore, the whole system is endangered by delay in implementation of training plans and certification of public procurement officers.

  9. Konkurentnost • Konkurentnostsistema je prema nalazima veoma dobra u fazi planiranja, ali slabija u potonjoj primeni tih planova. Prosečni broj ponuda po jednoj nabavci je prilično niska, što može da ukazuje na slabost privrede, previše stroge zakonske uslove i ograničenja za učešće u postupku javne nabavke te nizak nivo poverenja u integritet sistema. • Mogućnost korišćenja prednosti koje sa sobom nose javne nabavke po partijama nisu dovoljno iskorišćene. • U fazi izvršenja ugovora aneksi ugovora nisu retki, a opravdanje za njihovo zaključivanje obično ne postoji, ili makar ne postoji dokument koji o tome svedoči.

Skor za konkurentnost • Konkurentne procedure preovlađuju u sistemu javnih nabavki Score: 6 • Javni fondovi korišćeni u procesima nabavki izuzeti iz sistema javnih nabavki su ograničeni i minimalni Score: 10 • Postoji visok nivo konkurencije u postupcima javnih nabavki Score: 2,5 • Sistem javnih nabavki je otvoren za učešće stranih i domaćih ponuđača Score: 2 • Nekonkurentno ugovaranje sa prethodnim dobavljačima je ograničeno Score: 0

  11. Competitiveness • The competitiveness of the system proofed to be almost excellent in the planning phase, but weaker in later implementation of plans. The average number of bids per tender is rather low, eventually indicating weaknesses of country’s economy, sharpness of legal conditions and limits for firms to participate in public procurements and low level of confidence in system integrity. • The possibility to use advantages of procurements in lots is not sufficiently used. • In contract execution phase, annexes are not rare practice and justification is missing.

Score for Competitiveness • Competitive procedures are dominant in system of public procurement Score: 6 • Public funds spent in public procurement procedures excluded from general system is limited and minimal Score: 10 • There is high level of competition in public procurement tenders Score: 2,5 • Public procurement system is opened for participation of foreign and domestic bidders Score: 2 • Non-competitive contracting with previous supplier is limited Score: 0

Transparentnost • Transparentnosti uopšte nema u fazi planiranja nabavki. • Naručioci u velikoj većini poštuju osnovne zakonske dužnosti u vezi sa objavljivanjem oglasa o javnim nabavkama (na Portalu javnih nabavki i Službenom glasniku), pri čemu su primećeni i pozitivni trendovi u vezi sa objavljivanjem nabavki male vrednosti na Portalu. Međutim, nivo pro-aktivnog objavljivanja informacija o javnim nabavkama (više od onoga što zakon nalaže) je i dalje na veoma niskom nivou. • Slično tome, informacije o izvršenju ugovora o javnim nabavkama naručioci objavljuju samo ponekad i samo ako su one kadre da stvore povoljnu sliku o institucijama koje su ih sprovele.

Transparency • The transparency does not exist in planning phase. • The respect of basic legal duties related to the decision making procedure prevails (publishing of announcements in Portal and Official Gazette), with some positive trends in regards of publishing information about small value procurement, but the pro-active approach to publish more than the law asks for is largely missing. • Similarly, the information about contract execution are only occasionally published and only if preferable for procurement entities.

  17. Jednakost ponuđača • Jednakost ponuđača je obezbeđena samo delimično. Uslovi koji se postavljaju pred ponuđače i elementi kriterijuma u odnosu na koje treba da daju svoje ponude uglavnom postavljaju razumne zahteve u vezi sa finansijskim kapacitetima. S druge strane, procenu razložnosti traženih ljudskih i tehničkih resursa je gotovo nemoguće izvršiti u odsustvu dodatne dokumentacije – “procene potreba” na osnovu koje bi bilo utvrđeno da su baš takvi kapaciteti neophodni. • Pokazatelji o pretežnoj zastupljenosti “najniže cene” kao kriterijuma i veliki značaj koji je dat “najnižoj ceni” kao elementu kriterijuma, svakako su ohrabrujući sa stanovišta jednakosti ponuđača. Međutim, istovremeno, čini se da ova situacija negativno utiče na broj učesnika u nadmetanju jer uzrokuje određivanje karakteristika predmeta nabavke tako da se ne ostavlja mnogo prostora za modalitete prisutne na tržištu. • I dalje se prečesto zaključuju aneksi ugovora, što povređuje jednakost ponuđača post festum

  19. Equality of bidders • Equality of bidders seems to be partially ensured. Conditions and terms of references for bidders and bids are setting reasonable limits for financial capacity, while evaluation of asked human and technical capacities is impossible to make in absence of “needs assessment” documents and justification for public procurements. • Similarly, indicators of prevalence of “lowest price” method and high significance given to the “lowest price” within “value for money” are encouraging in terms of bidders’ equality, but at the same time, seems to affect adversary competition. • Annexes to the contracts are still present too often, thus harming post festum bidders’ rights.

  21. Integritet • Integritetsistema je samo delimično obezbeđen. Nizak procenat postupaka nabavki u kojima je podnošen zahtev za zaštitu prava više ukazuje na slabo poverenje koje ponuđači poklanjaju sistemu zakonske zaštite i želju da ne ulaze u sukobe sa potencijalnim budućim partnerima, nego na savršenost procedura i konkursne dokumentacije. • Odsustvo tužbi Upravnom sudu i odsustvo prekršajnih postupaka zbog kršenja Zakona o javnim nabavkama, kao i mali broj pokrenutih postupaka za zaštitu javnog interesa takođe su dokaz da se pravna sredstva za zaštitu integriteta sistema javnih nabavki ne koriste dovoljno.

  23. Integrity of the system • Integrity of the system is only partially ensured. The low percentage of procurements where request for protection of bidders’ right is lodged rather indicates low confidence in system and willingness not to go into conflict with possible future partners than perfectiveness of the procedures and terms of references. • The absence of lawsuits to administrative court and misdemeanor procedures as well as public interest protection initiatives proofs these legal tools to be not-sufficiently used.

Opšti zaključak • Ukupno, sistem javnih nabavki se pokazao umereno uspešan kada je reč o primeni osnovnih odredaba Zakona o javnim nabavkama. • Međutim, nedostaje spremnost da se učini više nego što zakon striktno nalaže i da se ostvare potpunije načela koja proklamuje, radi postizanja veće transparentnosti, planiranja budžeta i opravdanja potreba za javnim nabavkama. • Preterano oštra pravila za učešće u postupcima javnih nabavki, manjak profesionalnog osoblja kod naručilaca, malo poverenje u integritet sistema i slabo funkcionisanje kontrolnih mehanizama dodatno otežavaju postizanje načela i ciljeva javnih nabavki. • Zakonske mogućnosti za postizanje većih ušteda budžetskih sredstava se i dalje nedovoljno koriste.

  26. Overall conclusions • In overall, the system of public procurement proofed to be moderately successful in terms of implementation of basic provisions of Law on public procurement. • However, the system still lacks initiatives to go beyond these legal duties, in terms of greater transparency, budget planning or justification of needs. • Harsh legal limits, lack of professional staff, confidence in integrity of the system and oversight mechanisms are further hampering achievement of public procurement principals and goals. • Available tools to increase savings of public monies are insufficiently used.
