Changes • The 25% set aside calculation will change from 25% of total SSA federal IDEA-B tentative base entitlement amount to 25% of each SSA members’ base amount. • Residential Application Submission Form must be completed and all pages numbered. • Residential Application Documentation Form has been revised to include page numbers.

  5. General Procedures and Instructions for Completing the Application for Funding of Residential Placement (SAS-A111-13)

  6. Purpose • Provide an appropriate education for students whose needs are such that they require: • 24-hour, structured environment • Available only at a residential facility • Decision concerning placement is the responsibility of the ARD committee

  7. Residential Placement for Educational Purposes • Residential placement is necessary • In order for the student to make reasonable academic progress • Not for care and treatment purposes • Not primarily due to problems in the home

Residential Placement for Educational Purposes, cont. • TAC §89.61, Contracting for Residential Educational Placements for Students with Disabilities • Approval for state and federal funding negotiated on an individual student basis • Negotiated through the residential application • Submitted to the ESC; ESC submits to TEA • Submitted for educational purposes only

Non Public Schools for Students with Disabilities Approved for Contracting Purposes • Non public school must be approved by TEA if providing the educational services of the student • TEA maintains a current list • Updated annually • Check list on TEA website (link is in General Procedures and Instructions)

  11. Meeting to Discuss Options • Community Resource Coordination Groups (CRCGs) or • Group of people knowledgeable about the student • Determine whether noneducational support services are available so student can remain in or return to the community

On-Site Visit to Facility • Conducted by the LEA • Required if an initial or continuing residential placement • Must be conducted annually • Purpose is to determine if the facility can meet the goals of the student’s IEP • And to determine if the facility can meet the health and safety standards • Records of on-site visits must be retained in the LEA or SSA for program monitors to review when requested

ARD Committee Meeting • Confirms, on the basis of all options discussed and considered, that residential placement is required. • Addresses the items/questions on the application • Student’s IEP must: • Contain specific goals and objectives • Address the services for which funding is requested in the application • Ensures that a representative from the facility attends the meeting or participates by phone or conference call.

  14. Amendments to Residential Application • When do I amend? • Change of placement • Change of services • What do I submit? • IEP • Application • Contract • Cost Anaylsis • What is the timeline? • Within 45 school days of the date of the ARD

  15. If also applying for High Cost Funds (HCF) • Residential application must be submitted by September 1 to be eligible for HCF • If corrections/changes to the residential application are needed, they must be submitted to TEA within 15 business days • Deadline not met – HCF award will be denied

  16. Reintegration Plan • Plan is used to return the student to the LEA • Include the provision of noneducational services • For monitoring purposes include: • criteria for the student’s return • expected return date • Progress on the goals and objectives for return to the LEA is benchmarked

  17. Reintegration Plan, cont. • Recommended Reintegration Plan included with General Procedures and Instructions • Plan remains at the LEA, not submitted to TEA • Statements of Assurances address the Reintegration Plan

Contract with Residential Facility • Copy must be submitted with the residential application • Must include all services required in the IEP • Include costs on Residential Placement Cost Breakdown form • All parties retain a copy • Contracts must address requirements of 34 CFR §80.36 (i) (copy included with General Procedures and Instructions)

  19. Agreement for Special Education Services • Required when the residential facility is not providing the instruction and an LEA is • Sample agreement included with General Procedures and Instructions • Must be submitted with application • All parties retain a copy

Specific Aspects of the Application and Approval Process • Submit one original and one copy to ESC • Separate application for each student • Student with ED – must confer with local MHA • Student with intellectual disability or AU – must confer with local MRA • Students with other disabilities – no consultation with MHA/MRA required

Specific Aspects of the Application and Approval Process, cont. • Signature of superintendent of LEA or fiscal agent of SSA required • Letter of authorization must be submitted if designee signs • Before student returns to the community, highly recommend a discussion about the student’s needs at a CRCG meeting • Discuss needs for local resources • Review most recent reintegration plan

Specific Aspects of the Application and Approval Process, cont. • Approval of application received through a letter of approval from TEA • Mailed to superintendent of the LEA or FA • Copy of Residential Placement Cost Breakdown form attached • Indicates amount of discretionary funds awarded • Amount of discretionary funds approved only if cost exceeds 25% set aside and the local tax share amount

Specific Aspects of the Application and Approval Process, cont. • ARDC decisions regarding residential placement are binding • If application is not approved, costs must be paid from local funds • Effective dates of application • September 1 if received by ESC on or before September 1 • As of stamp-in-date if received after September 1 • Through August 31, unless otherwise indicated
